HomeMy WebLinkAboutORDINANCE - 2644 - 5/26/1998 - ZONING VARIATION/1735 GIBSON DTORDINANCE NO. 2644 AN ORDINANCE GRANTING A VARIATION OF SECTION 7A-1:B.3.A OF THE ZONING ORDINANCE PERTAINING TO THE LOCATION OF OPEN FENCES TO PERMIT AN OPEN FENCE TO BE LOCATED ON THE SIDE PROPERTY LINE BETWEEN THE REAR LOT LINE AND A POINT 7 FEET NORTH OF THE SOUTHWEST CORNER OF THE HOUSE ON PROPERTY LOCATED AT 1735 GIBSON DRIVE. ELK GROVE VILLAGE WHEREAS, the Zoning Board of Appeals of the Village, at a Public Hearing, duly called held and according to law, considered the question of granting a variation from the provisions of the Zoning Ordinance pertaining to corner lot fence restrictions for a solid fence located on the side property line on property located at 1735 Gibson Drive, Elk Grove Village; and WHEREAS, the Zoning Board of Appeals voted to deny said variation causing the petitioner to amend its variation request for an open fence along the side property line butting Biesterfield Road; and WHEREAS, the President and Board of Trustees of the Village after having considered the recommendation and initial findings of the Zoning Board of Appeals as well as independently reviewing the amended request of the petitioner find and believe that sufficient hardship exists to permit an open fence in the area requested. NOW, THEREr'ORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 7A-1:B.3.a of the Zoning Ordinance to permit an open fence to be located on the side property line along Biesterfield Road from the rear property lot line to a point 7 feet north of the southwest corner of the rear portion of the house on property located at 1735 Gibson Drive, Elk Grove Village and legally described as follows: Lot 32 in Winston Grove Section 23A, being a Subdivision in parts of Section 25 and 26, Township 41 North, Range 10, East of the Third Principal Meridian, in Cook County, Illinois. Section 2: That this variation shall be in full force and effect from and after its passage and approval according to law.
