HomeMy WebLinkAboutORDINANCE - 2646 - 6/9/1998 - DIS-ANNEXING PROPERTY AMERICAN HOUSING PARTNERSORDINANCE NO. 2646 AN ORDINANCE RESCINDING ORDINANCE NO. 2564 DULY PASSED AND APPROVED ON MAY 27, 1997 THEREBY AUTHORIZING DIS -ANNEXING OF PROPERTY WHICH HAD BEEN ANNEXED TO THE VILLAGE PURSUANT TO PETITION OF AMERICAN HOUSING PARTNERS WHEREAS, the Village and American Housing Partners entered into an annexation agreement approved by the President and Board of Trustees pursuant to Resolution No. 25-97 duly passed and approved on May 27, 1997, which agreement authorized the annexation of certain property to the Village subject to the condition that American Housing Partners acquire legal title to said property within 12 months from the date of the annexation agreement; and WHEREAS, American Housing Partners has failed to acquire legal title to the subject property of said annexation agreement and therefore by the terms of the agreement, all of the terms and conditions are subject to being deemed null and void; NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Ordinance No. 2564 duly passed and approved by the Village on May 27, 1997 is hereby rescinded and all of the terms and conditions set forth therein, including zoning and land use, are deemed null and void and of no further force and effect. Section 2: That the annexation agreement between the Village and American Housing Partners duly adopted and approved pursuant to Resolution No. 25-97 is hereby, according to its terms, deemed null and void and of no further force and effect. Section 3: That the Village Clerk is authorized to amend the zoning map of the Village to incorporate the terms of this Ordinance. Section 4: That the Village Clerk be authorized to file the appropriate plat of dis- annexation with the Cook County Recorder of Deeds together with such other filing as is required by said Recorder to effectuate the provisions of this Ordinance. Section 5: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 5 NAYS: 0 ABSENT: 1 PASSED this 9th day of 1998.
