HomeMy WebLinkAboutORDINANCE - 2669 - 11/17/1998 - ZONING VARIATION/SPRUCE MEADOWSORDINANCE NO. 2669 AN ORDINANCE GRANTING A VARIATION OF SECTION 7A -1B-3 (b) OF THE ZONING ORDINANCE TO PERMIT THE CONSTRUCTION OF A SOLID FENCE ON THE SIDE LOT LINE FRONTING A MAJOR ARTERIAL STREET AND A VARIATION OF SECTION 3-6-B AND 3-6D-1 TO PERMIT THE CONSTRUCTION OF AN ATTACHED GARAGE THAT WOULD ENCROACH 5.5 FEET INTO THE REQUIRED 25 FOOT SETBACK ON LOT 1 OF THE SPRUCE MEADOWS SUB -DIVISION, AND LEGALLY DESCRIBED HEREINAFTER WHEREAS, the Zoning Board of Appeals, at a public hearing duly called and held according to law, considered the question of granting several variations to permit the construction of a solid fence on the side lot line and a garage which encroaches 5.5 feet into the 25 foot set back line on Lot 1 of the Spruce Meadows subdivision; and WHEREAS, the President and Board of Trustees, after having reviewed the findings and recommendation of said Zoning Board of Appeals, find and believe that sufficient hardship exists so as to justify the granting of said variations. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 7A -1B-3 (b) of the Zoning Ordinance to permit the construction of a solid fence located directly on the side lot line fronting a major arterial street on property located in the Spruce Meadows subdivision and legally described in Section 3 hereinafter. Section 2: That there be granted a further variation of Section 3-6B and 3-6D1 requiring principal structures to be located at least 25 feet from lot lines fronting on public streets to permit the construction of an attached garage that would encroach approximately 5.5 feet into the required 25 foot set back area on property located on Lot 1 in the Spruce Meadows subdivision and legally described in Section 3 hereinafter. Section 3: That the subject property is legally described as follows: Lot 1 in Spruce Meadows Subdivision, being a Subdivision of Part of the East '-� of the Southeast Quarter of Section 29, Township 41 North, Range 11 East of the Third Principal Meridian, according to the Plat thereof Recorded April 28, 1995 as Document No. 95282215, in Cook County, Illinois. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
