HomeMy WebLinkAboutORDINANCE - 2680 - 2/9/1999 - FOOD DEALERSORDINANCE NO. 2680 AN ORDINANCE REESTABLISHING ARTICLE C FOOD DEALERS AS A LICENSED AND REGULATED BUSINESS IN THE VILLAGE OF ELK GROVE VILLAGE WHEREAS, on September 22, 1998 the Village adopted Ordinance 2663, which Ordinance, in part, repealed Article C Food Dealers of Title 3 of the Village Code; and WHEREAS, on further review it was deemed necessary that Article C be reinstated due to licensing considerations of the Village Code. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Chapter 5 Food Related Business of Title 3 Business and License Regulations of the Village Code be amended by reinstating therein, Article C Food Dealers, which Article shall read as set forth in Exhibit A, attached hereto, and by this reference, incorporated herein. Section 2: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 9th day of February , 1999. FOOD DEALERS SECTION: 3-5C-1: Definition 3-5C-2: License Required 3-5C-3: Application for License 3-5C-4: Inspections 3-5C-1: DEFINITION: "Food dealer" shall mean any establishment, firm, corporation or person engaged in the retail sale of foodstuffs, beverages (other than intoxicating liquor) or milk/milk products directly to the public for the purpose of household use and consumption. 3-5C-2: LICENSE REQUIRED: It shall be unlawful for any person to operate as a food dealer, either by himself or through an agent, employee or partner, without first having obtained a license as is herein provided. 3-5C-3: APPLICATION FOR LICENSE: An application for a license under this Article shall be made in conformity with the general requirements of this Code relating to applications for licenses. Such application shall also specify the number of employees to be employed by the applicant in his business. 3-5C-4: INSPECTIONS: It shall be the responsibility of the Health Officer to make or cause to be made such inspections as may be necessary to insure compliance with the provisions of this Article and all other ordinances related hereto.
