AN ORDINANCE GRANTING CONDITIONAL USE PERMITS TO ELK GROVE
TOWN CENTER, L.L.C. (HAMILTON PARTNERS) PURSUANT TO SECTION 711-5-
2C. OF THE ZONING ORDINANCE TO PERMIT AN INDOOR THEATER AND A
TWO -WINDOW DRIVE-THRU FACILITY IN CONNECTION WITH A PHARMACY
FOR THE B-5 TOWN CENTER SHOPPING DISTRICT LOCATED AT THE
SOUTHWEST CORNER OF ARLINGTON HEIGHTS ROAD AND BIESTERFIELD
ROAD, ELK GROVE VILLAGE
WHEREAS, the Village has received a request from Elk Grove Town Center L.L.C. to
consider the granting of Conditional Uses for an indoor theater and for a two -window drive-thru
facility, for the drop off and purchase of medical prescriptions in connection with the operation
of a pharmacy on property located at the Southwest corner of Arlington Heights Road and Bies-
terfield Road, Elk Grove Village; and
WHEREAS, the President and Board of Trustees after having considered the recommen-
dation of Village staff as presented by the Village Manager, find and believe that the granting of
a Conditional Use for a six -screen indoor theater and a Conditional Use for a drive-thru facility
for the drop off and purchase of medical prescriptions only is in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That there be granted a Conditional Use for an indoor theater, which theater
shall consist of six (6) screens with a maximum seating of 1,194 seats. The theater shall have
222 parking stalls allocated for its use, a variation of ten parking stalls from the required parking
according to Village Ordinance, which variation is hereby approved.
Section 2: That there is granted a Conditional Use to Elk Grove Town Center L.L.C., on
behalf of Walgreens Drug Store to permit a two -window drive-thru facility for the drop off and
purchase only of medical prescriptions in connection with the operation of a pharmacy. The drop
off or purchase of any other item other than medical prescriptions is prohibited under the provi-
sions of this Conditional Use Permit.
Section 3: That this Ordinance shall be in full force and effect from and after its passage
and approval according to law.
