HomeMy WebLinkAboutORDINANCE - 2552 - 4/8/1997 - SPECIAL USE/1951 BUSSEORDINANCE NO. 2552 AN ORDINANCE GRANTING A SPECIAL USE PERMIT AND A VARIATION TO PERMIT THE CONSTRUCTION AND OPERATION OF A DRIVE-THRU RESTAURANT AT AN EXISTING FACILITY LOCATED AT 1951 BUSSE ROAD, ELK GROVE VILLAGE (AUTUMN HOUSE) WHEREAS, the Plan Commission and the Zoning Board of Appeals of the Village, at a joint public hearing, considered the question of granting a Special Use Permit to operate a drive- thru restaurant and a variation of Section 3-6-B, 3-6-D and 7-1 of the Zoning Ordinance pertain- ing to structures in the 25 foot minimum front yard setback respectively, for property located at 1951 Busse Road and legally described hereinafter; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having considered the recommendation and finding of the Plan Commission and the Zoning Board of Appeals, find and believe that it is in the best interest of the Village to grant a Special Use Permit as requested and that sufficient hardship exists so as to justify the granting of the var- iation as requested. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a Special Use Permit to Kostas Konstantopoulos (Au- tumn House Restaurant) to permit the construction and operation of a drive-thru restaurant in an industrial zoned district, on property located at 1951 Busse Road, and legally described as follows: Lot 1 in Hollanders Resubdivision, being a Resubdivision in Section 35, Township 41 North, Range 11, East of the Third Principal Meridian, ac- cording to the Plat thereof recorded on September 27, 1977 as Docu- ment No. 24123522, in Cook County, Illinois Section 2: That there be granted a variation of Section 3-6-13, 3-6-D and 7-1 of the Zoning Ordinance pertaining to structures in the required 25 foot minimum front yard setback to permit the construction of a building addition adjacent to Pratt Boulevard that would encroach 5 feet 3 inches into the required 25 foot minimum front yard setback for property located at 1951 Busse Road, Elk Grove Village and legally described above. Section I That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 8th day of April , 1997.
