HomeMy WebLinkAboutORDINANCE - 2562 - 5/27/1997 - DISORDERLY CONDUCTORDINANCE NO. 2562 AN ORDINANCE AMENDING SECTION 6-6-1-1 DISORDERLY CONDUCT OF THE VILLAGE CODE BY PROHIBITING THE POSSESSION OF ALCOHOLIC BEVERAGE IN CERTAIN PUBLIC PLACES IN THE VILLAGE OF ELK GROVE WHEREAS, the Police Department of the Village has advised the President and Board of Trustees of problems which exist concerning the possession or consumption of alcoholic be- verage in certain public places within the Village; and WHEREAS, such public places include the parking and common areas of multi -family residential structures in the Village; and WHEREAS, the owners of certain multi -family residential structures have requested that the Village adopt and enforce a disorderly conduct ordinance pertaining to the possession of al- coholic beverage in said parking and common areas; and WHEREAS, the President and Board of Trustees after having considered the recommen- dation of the Police Department and the concerns of multi -family residential property owners of the Village find and believe it to be in the best interest of the Village that an amendment to the Disorderly Conduct Section of the Village Code be adopted prohibiting the possession of alco- holic beverages in certain public places. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 6-6-1-1 Disorderly Conduct of Chapter 6 Miscellaneous Of- fenses of the Village Code of the Village of Elk Grove Village be and the same is hereby amended by adding thereto a new paragraph, to be placed in said Section in its appropriate alpha- betical location, which paragraph shall read as follows: L. Is in possession of an alcoholic beverage in a public street or other public place; unless the alcoholic beverage is in its original container with the seal un- broken or unless the possession is on the premises of an establishment holding a valid Village of Elk Grove Village liquor license. For the purpose of this subsec- tion, a public place shall include, but not be limited to, all Village streets, Village owned parking facilities, all parking lots and common areas serving commercial establishments and all parking areas and common areas serving multi -family re- sidential structures containing four or more dwelling units, provided that this pro- hibition shall apply to such multi -family common areas only if the owner, mana- ger, or owners association has stated, in writing, that it is the intention of the ownership that the prohibition be applied. The written statement may reserve the right of management to give one day permits for residents or tenants to hold social gatherings in a common area. Section 2: That any person, firm or corporation who violates any of the provisions of this Ordinance shall be subject to a fine of not less than Twenty -Five ($25.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense. form. Section 3: That the Village Clerk is authorized to publish this Ordinance in pamphlet Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
