AN ORDINANCE AMENDING CHAPTER 5 ANIMALS AND ANIMAL CONTROL OF
TITLE 6 OF THE VILLAGE CODE OF THE VILLAGE OF ELK GROVE VILLAGE
BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove
Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That Section 6-5-2: Definitions of Title 6 of the Village Code be amended by
changing the definition of Animal and by adding thereto definitions for Animal Shelter, Animal
Foster Home, Breeder (Hobbiest) and Breeder (Professional) which changes shall read as
follows:
ANIMAL: Any living creature, domestic or wild, other than a human being.
ANIMAL SHELTER: A facility operated, owned or maintained by a duly incor-
porated humane society, animal welfare society or other non-profit organization
for the purpose of providing for and promoting the welfare, protection and hu-
mane treatment of animals. Animal shelter also means any veterinary hospital or
clinic operated by a veterinarian or veterinarians licensed under the "Veterinary
Medicine and Surgery Practice Act", as now or hereafter amended, which operates
for the above mentioned purpose in addition to its customary purposes.
ANIMAL FOSTER HOME: An entity that accepts the responsibility for steward-
ship of animals that are the obligation of an animal shelter, not to exceed four (4)
animals at any given time. Permits to operate as a "foster home" shall be issued
through the animal shelter.
BREEDER (HOBBIEST): Means any person(s) who breeds animals, normally
dogs or cats, as a hobby.
BREEDER (PROFESSIONAL): Means any person(s) who breeds animals, nor-
mally dogs or cats, and maintains affiliation in a nationally recognized society for
that breed.
Section 2: That Section 6-5-3: Certain Animals Prohibited of Title 6 be amended by add-
ing thereto the following:
C. Poisonous Animals: No person shall keep or permit to be kept on his pre-
mises any poisonous animals or arthropod.
Section 3: That subparagraph I. of Section 6-5-6: Animal Nuisances of Title 6 be and the
same is hereby amended to read as follows:
1. To allow any animal to molest passersby, attack persons or animals, damage
or impair the value of property, detrimentally affect the public health, safety
and welfare.
Section 4: That Section 6-5-9: Prohibited Acts and Conditions of Title 6 be amended by
adding thereto a new paragraph which shall read as follows:
C. Injury to Animals: No person shall keep or harbor an animal in such a
manner so as likely to cause injury to the animal in any way.
Section 5: That Section 6-5-13: Enforcement and Section 6-5-14: Penalties be and the
same are respectively renumbered to Section 6-5-14: Enforcement and Section 6-5-15: Penalties.
Section 6: That a new Section 6-5-13: Animal Shelters and Animal Foster Homes;
Breeders be established, which Section shall read as follows:
6-5-13: ANIMAL SHELTERS AND ANIMAL FOSTER HOMES;
BREEDERS
A. State License: All animal shelters operating within the Village must be li-
censed by the Illinois Department of Agriculture. All animal foster homes
operating within the Village must have a permit issued by a state accredited
animal shelter. Any animal shelter or animal foster home operating within
the Village must comply with the rules set forth in the Illinois Animal Wel-
fare Act.
B. Breeders: Any breeder, whether a breeder (hobbiest) or a breeder (pro-
fessional) shall not permit any one animal to produce more than two litters
in any one calendar year.

Section 7: That any person, firm or corporation violating any of the provisions of this
Ordinance shall be subject to a fine of not less than Twenty -Five ($25.00) Dollars nor more than
Five Hundred ($500.00) for each offense.
Section 8: That the Village Clerk is hereby authorized to publish this Ordinance in pam-
phlet form.
Section 9: That this Ordinance shall be in full force and effect from and after its passage
and approval according to law.
