HomeMy WebLinkAboutORDINANCE - 2584 - 8/12/1997 - ANNEXING1920 NERGE RDORDINANCE NO. 2584 AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE REZONING THE PROPERTY TO THE A-2 MULTIPLE -FAMILY RESIDENCE DISTRICT AND GRANTING A SPECIAL USE PERMIT TO PERMIT THE CONSTRUCTION AND OPERATION OF A 101 UNIT/109 BED ASSISTED LIVING FACILITY ON PROPERTY LOCATED AT 1920 NERGE ROAD, ELK GROVE VILLAGE, ILLINOIS WHEREAS, a written petition has been filed with the Village Clerk of the Village of Elk Grove Village by ManorCare Health Services, Inc., said petition seeking annexation to the Village of Elk Grove Village of certain land and territory legally described hereinafter; for the rezoning of said property to the A-2 Multiple -Family District and for a Special Use Permit Amendment to permit a one hundred and one (101) Unit/one hundred and nine (109) bed assisted living facility and a variation to allow three (3) buildings on one (1) lot and a variation in the required parking spaces from 196 to 190; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village; and WHEREAS, public hearings have been held before the Plan Commission to consider the rezoning of the subject property from R-3 Residential to A-2 Multiple -Family; for consideration of the issuance of a Special Use Permit; and for the construction of a one hundred and one (101)unit/one hundred and nine (109) bed assisted living facility; and a variation in required parking spaces to permit a reduction from 196 to 190 spaces. WHEREAS, any Fire Protection District, Library District, Township Road Commissioner, County Clerk or other entity or person entitled to notice prior to the annexation of the subject property has been given such notice as is required by law; and WHEREAS, the Owner and Village have entered into a Pre -Annexation Agreement with respect to the annexation of the subject property to the Village, which Annexation Agreement was duly considered at a public meeting, duly called and held according to law and which Agreement was approved by the President and Board of Trustees of the Village pursuant to Resolution No. 37-97 duly passed and approved on the 12th day of August , 1997; and NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the land and territory, legally described on Exhibit A, attached hereto and by this reference incorporated herein, which land and territory is contiguous to the Village of Elk Grove Village, and not within the limits of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boundary limits of said Village as is by law in such case made and provided. Section 2: That pursuant to public hearing and recommendation and finding of the Plan Commission of the Village, the Village does hereby rezone the subject property from R-3 Residential to A-2 Multiple -Family. Section 3: That pursuant to public hearing and recommendation and finding of the Plan Commission, the Village hereby grants a Special Use Permit to permit the construction of a one hundred one (101) unit/one hundred nine (109) bed assisted living facility; a variation of the Zoning Ordinance to allow three (3) buildings on one (1) zoned lot; and a variation in required parking spaces to permit a reduction from 196 to 190 spaces. -2- Section 4: That this annexation is in conjunction with and subject to the terms and conditions set forth in the Annexation Agreement heretofore referenced. Section 5: That the Village Clerk is directed to record a certified copy of this Ordinance, together with a Plat of Annexation of said territory with the Recorder of Deeds of Cook County, Illinois. Section 6: That the Village Clerk is directed to amend the official map of the Village in accordance with the annexation herein and is further authorized to publish this Ordinance in pamphlet form. Section 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED this 12th day of August , 1997.
