AN ORDINANCE REZONING PROPERTY LOCATED AT THE SOUTHWEST
CORNER OF YORK ROAD AND DEVON AVENUE FROM I-2 INDUSTRIAL
TO B-3 AUTOMOTIVE ORIENTED BUSINESS IN ORDER TO CONSTRUCT
A 24 HOUR GASOLINE SERVICE STATION AND 4,000 SQUARE FOOT
CONVENIENCE CENTER (THORNTON OIL CORPORATION)
WHEREAS, the Plan Commission of the Village of Elk Grove Village,
acting as a Zoning Commission, at a Public Hearing, duly called and held
according to law, considered the question of rezoning property located in
the Village, after having considered the recommendation and finding of
said Plan Commission, find and believe it to be in the best interest of
the village to rezone the property as requested.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That the property located at the southwest corner of
York Road and Devon Avenue be rezoned from the I-2 Industrial District to
the B-3 Automotive Oriented Business District for the purpose of
constructing a 24 hour gasoline service station and a 4,000 ft.
convenience center on property legally described as follows:
Lots 1 and 4 in Melvin's Subdivision of part of
the North 1/2 of the East 1/2 of the Northeast 1/4
of Section 2, Township 40 North, Range 11, East of
the Third principal Meridian, according to the Plat
thereof recorded January 16, 1975 as Document
No. R75-02474, in DuPage County, Illinois.
Section 2: That in conjunction with the rezoning, the Village will
review applicable setback requirements for underground storage tanks and
advise the owners of the required setbacks. In addition, owners shall
submit a landscaping/fencing plan to the Plan Commission for final review
and approval.
Section 3: That the Village Clerk is hereby directed to amend the
official map of the Village in accordance with the provisions of this
ordinance.
Section 4: That this Ordinance shall be in full force and effect
from and after its passage and approval according to law.
