AN ORDINANCE GRANTING A VARIATION OF SECTION 3-6:D.3 OF THE ZONING
ORDINANCE PERTAINING TO SETBACK REQUIREMENTS FOR FENCES TO
PERMIT THE CONSTRUCTION OF A FENCE THAT WOULD ENCROACH BEYOND
THE BUILDING SETBACK LINE ON PROPERTY LOCATED AT 900 ELMHURST
ROAD, ELK GROVE VILLAGE (GROOT INDUSTRIES, INC.)
WHEREAS, the Zoning Board of Appeals at a public hearing duly called and held ac-
cording to law considered the question of granting a variation of Section 3-6:D.3 of the Zoning
Ordinance to permit the construction of a fence which would encroach beyond the building set-
back line on property located at 900 Elmhurst Road and legally described hereinafter; and
WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village
afer having reviewed the recommendation and finding of said Zoning Board of Appeals find and
believe that sufficient hardship exists so as to justify the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section 3-6:13.3 of the Zoning Ordinance,
as it pertains to setback requirements for fences, to permit the construction of a fence that would
encroach beyond the building setback line on property located at 900 Elmhurst Road, Elk Grove
Village and legally described as follows:
NORTH SECTION
Lot 1 in Reimers' Industrial Tract in the North 1/2 of the Southeast 1/4 of Section
26, Township 41 North, Range 11, East of the Third Principal Meridian according
to the Plat thereof recorded September 20, 1968 as Document 20622044, in Cook
County, Illinois
SOUTH SECTION
Lot 1 in Webb Hotels of Illinois Resubdivision of Lots 3 and 4 in O'Hare Indus-
trial Center for Business, a Resubdivision of Lot 1 in Higgins Elmhurst Subdivi-
sion No. 1 in Higgins Elmhurst No. 2, being Subdivisions of the Southeast Quar-
ter of Section 26, Township 41 North, Range 11, East of the Third Principal Meri-
dian according to the Plat thereof recorded September 16, 1986 as Document
86418230 in Cook County, Illinois
Section 2: That this Ordinance shall be in full force and effect from and after its passage
and approval according to law.
