HomeMy WebLinkAboutORDINANCE - 2529 - 1/14/1997 - TOBACCO, SALE OF BY MINORSORDINANCE NO. 2529 AN ORDINANCE AMENDING ARTICLE B. OF CHAPTER 6 OF THE VILLAGE CODE AS IT PERTAINS TO THE SALE OF TOBACCO BY MINORS AND TO MINORS WITHIN THE VILLAGE OF ELK GROVE WHEREAS, the Judiciary Planning and Zoning Committee of theVillage, at a public meeting duly called and held, considered the question of enacting more stringent controls on the sale of tobacco by minors and to minors within the Village limits; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having considered the recommendation of said Judiciary Planning and Zoning Committee as well as comments from the principal of the Elk Grove High School, find and believe it to be in the best interest of the Village that the cigarette and tobacco provisions of Chapter 6 of the Village Code be amended as recommended by the Committee. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 3-613-1 Definitions of the Village Code be and the same is here- by amended by adding thereto the Definition of Minors which shall read as follows: MINORS. Any person seventeen (17) years or under. Section 2: That Section 3-613-41) be amended by adding thereto the following paragraph: 6. SALE BY MINORS: It shall be unlawful for any minor to sell tobacco products. Section 3: That Section 3-613-5 Inspections shall be amended to read as follows: 3-613-5 INSPECTIONS: It shall be the responsibility of the Chief of Police or his designated agent to make or cause to be made such inspections to ensure compliance with provisions of this Article, all applicable laws of the State of Illinois, and all other ordinances relating hereto. Section 4: That Section 3-613-6 Administration of Provisions; Suspension or Revocation of License shall be amended by adding thereto a second paragraph, which paragraph shall read as follows: Every act or omission of whatsoever nature, constituting a violation of any of the provisions of this Article, by any officer, director, manager or other agent or em- ployee of any licensee shall be deemed and held to be the act of such licensee; and such licensee shall be subject to such penalties as if such act or omission had been done or omitted by the licensee personally. Section 5: Any person who violates any of the provisions of this Ordinance shall be sub- ject to a fine of not less than Twenty -Five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00 for each offense. Section 6: That the Village Clerk is hereby authorized to publish this Ordinance in pam- phlet form. Section 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
