HTS.& BIESTERFIELDORDINANCE NO. 2539 AN ORDINANCE REZONING CERTAIN PROPERTY LOCATED AT THE SOUTHWEST CORNER OF ARLINGTON HEIGHTS ROAD AND BIESTERFIELD ROAD FROM B-1 BUSINESS TO B-5 TOWN CENTER SHOPPING DISTRICT WHEREAS, the Plan Commission of the Village of Elk Grove Village at a public hear- ing duly called and held according to law considered the Petition of the Village of Elk Grove and Hamilton Partners Retail Division #1 to rezone property, formerly identified and known as the Grove Mall Shopping Center, from the B-1 General Business District to the newly established B- 5 Town Center Shopping District; and WHEREAS, the Plan Commission after having heard testimony by the Village Attorney, the Village President and representatives of Hamilton Partners, find and believe that the rezoning of said property to the B-5 Town Center Shopping District is in the best interest of the Village; and WHEREAS, the President and Board of Trustees of the Village concur in the findings of the Plan Commission; and WHEREAS, the preparation and delivery of a written report and findings by the Plan Commission to the Board of Trustees is hereby waived as a result of the Board's involvement with the public hearing process. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the property located at the Southwest corner of Arlington Heights Road and Biesterfield Road, which property is legally described on Exhibit A attached hereto, be and the same is hereby rezoned from the B-1 General Business District to the B-5 Town Center Shopping District. Section 2. That the Village Clerk is authorized to amend the Zoning Map of the Village in accordance with the provisions of this Ordinance. Section 3: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 5 NAYS: 0 ABSENT: 1 Dennis J.
