Kozor, Deputy Director, Community Development Zoning Variation – Docket #22-5 316 Walter Avenue Chairman Childress called the meeting to order at 7:00 p.m. and read a statement describing the hearing notification procedure as well as the legal notice. Section 3-7: D (1) does not permit the principal structure to be located in the required twenty-five foot (25’) front yard in the R-3 zoning district. The petitioner is requesting to install a covered porch that projects five feet (5’) into the required front yard. Petitioners Paul and Donna Szilvagyi (Owners of Record), were sworn in and asked to state their case for requesting a zoning variation. The petitioner’s hardship is that he wanted to change the look of the house and install a covered front porch to protect the front door from the sun, rain, wind, and snow. They had installed several doors over the years due to door failure from weathering based upon the direction the house faces and the exposure to the elements. They have a wooden door installed currently that recommends a covering being installed over the door to provide protection from the elements. Chairman Childress opened the meeting to questions from the board. The Members discussed how often the petitioners had to replace the door, the size of the door, the type of the door, and if they proposed to enclose the porch overhang. The Members asked if the petitioner had any additional construction drawings or details for the specific type of porch that was proposed to be built. The petitioner stated that they did not hire a contractor or pursue an actual design as they were waiting to determine if the variance for the porch would be approved prior to pursuing a design. The petitioner provided another picture to the Members that showed a house similar to theirs that had an overhang and pillars similar to what they were looking to install. The petitioner stated that their neighbors had no objection to the installation. Community Development staff received no inquiries or objections from the public regarding this variance request. Community Development staff had no comments. Member Damptz Jr. stated that he wanted to see the actual plans and proposal to see what the modification would look like prior to approving the variance request. No members of the public were present. Chairman Childress called for the motion. A Motion to CONTINUE the hearing was made by Damptz. Jr., No Motion to second the request was made. A Motion to DO GRANT a variation to Section 3-7: D (1) of the Elk Grove Village Zoning code to install a five foot (5’) covered front porch in the required twenty-five (25’) foot front yard was made by Member Latrofa and seconded by Member Glimco. Upon voting (AYES – Childress, Glimco, Latrofa, Rawleigh) (NAYES – Romanski, Damptz Jr.) (ABSENT – Bookler, Serrano, Spragg) The motion carried. Mr. Childress advised the petitioners to contact the Village Clerk and be available for the subsequent Village Board Meeting on June 21, 2022. Mr. Childress called for a motion to adjourn. The motion carried.
