Zoning Variation — Docket #22-10 115 Tower Lane
Chairman Childress called the meeting to order at 7:00 p.m. and read a statement describing the hearing
notification procedure as well as the legal notice.
Section 3-7: D (3) prohibits fences from being constructed within the required front yard and beyond a
line extended from the nearest front corner of the principal building located on an adjacent single-family
residential lot. The petitioner is requesting to install a four foot (4') high fence which will extend
approximately nine feet (T) beyond the nearest front corner of the principal structure on the adjacent
single-family residential lot to the south at 510 Middlebury Lane. There currently is no fence in this
location.
The petitioner, Bernadette Ciardullo, was sworn in and asked to present her case.
Ms. Ciardullo, (Owner of Record), stated that her property backs up to her neighbor's house at 510
Middlebury Lane and she recently has adopted a dog. Her house is close to the high school.
Additionally, she would like to install the fence for added security.
Chairman Childress opened the meeting to questions from the board.
Member Spragg stated that Ms. Ciardullo's neighbor, Fred Larson of 510 Middlebury Lane, submitted a
letter approving the location of the fence and allowing the petitioner to attach the proposed fence to his
fence.
Member Bookler asked what type of fence was proposed.
The petitioner responded that she is proposing a four foot (4') chain link fence to keep the dog secure.
Member Romanski asked if the fence was going to be installed adjacent to the back or front of her
existing shed.
The petitioner responded that it will be installed at the back of her shed.
Chairman Childress stated that there are no visibility issues with this proposed open type fence.
Chairman Childress read the letter from Fred Larson, 510 Middlebury Lane, stating his approval of the
location for the installation of this fence into the record.
Community Development staff received no inquires requesting information on this variation.
Community Development staff had no comments.
Chairman Childress called for the motion.
A Motion to DO GRANT a variance to permit the installation of a four foot (4') high fence which will
extend approximately nine feet (9') beyond the nearest front corner of the principal structure on the
adjacent single-family residential lot to the south at 510 Middlebury Lane was made by Member
Romanski which was seconded by Member Damptz Jr.
Upon voting (AYES — Bookler, Childress, Damptz Jr., Glimco, Romanski, Serrano, Spragg) (NAYES —
None) (ABSENT — Latrofa, Rawleigh)
The motion carried.
Mr. Childress called for a motion to adjourn.
The meeting adjourned at 7:15 p.m.
