Commissioner Rettberg seconded the motion_ Upon voting (Glass, Carlson, Schumm, Weiner, Morrill, Bacigalupo, AYES), the motion passed. Gabiga stated the Petitioner made modifications based on comments from the Fire Department, but that the Fire Department had reviewed and approved the most recent version of the exhibit. Commissioner Bacigalupo asked about the legal relationship of the Petitioner to the owner of Zuhba Pop Foods. J. Armando stated that she represents MRV Architects and is acting on behalf of Zuhba Pop Foods LLC. Commissioner Bacigalupo asked if Zuhba Pop Foods is a franchisee of Popeyes Louisiana. Kitchen. J_ Armando stated that is correct. Commissioner Bacigalupo stated that he is concerned about increased traffic in the area and the safety of bicyclists and pedestrians. J. Armando stated there will be an ADA-compliant sidewalk that will allow pedestrian access. Commissioner Morrill asked the Petitioner to explain the traffic flow of the drive-thru and parking lot. J. Armando stated that cars will enter through the west side of the parking lot, go through the drive-thm area, then can make a right on Arlington Heights Road or exit west through the parking lot and return to the shopping center. Commissioner Morrill asked how many cars the drive-thru can stack. J. Armando stated the drive- thru can stack 12 cars and that this quantity meets Village requirements. Commissioner Morrill asked how long cars are expected to take going through the drive-thru. J. Armando stated she is not sure. M. Jablonski stated that the Village requires 12 stacking spaces for drive-thrus and the Petitioner meets the requirements for stacking. Commissioner Schumm asked why the title commitment does not match the name listed by the Petitioner on their Special Use appication. J. Armando stated that Zuhba Pop Foods is a franchisee and Popeyes Louisiana Kitchen is a franchise. Commissioner Rettberg asked if visitors are able to directly exit onto Arlington Heights Road from the Popeyes parking lot. J. J. Armando stated the plans meet all requirements for parking. Commissioner Carlson stated the adjacent parking lot is never ful'L Commissioner Weiner stated she has no further questions. Commissioner Geinosky asked for the maximum number of employees working at one time. J. Armando stated there will be a maximum of 8 employees on their largest shift. Commissioner Geinosky asked when the largest shift is. J. Armando stated the maximum number of employees is expected during peak times such as weekends and evenings. Commissioner Geinosky asked how many seats will be available indoors. J. Armando stated there will be 52 seats inside. M. Jablonski stated the outlot meets the Zoning Code requirements for restaurant parking. R. Raphael explained that parking requirements are determined by square footage and stated the Petitioner meets those requirements. Commissioner Geinosky asked why there are two lots titled "Lot #2" on the Plat of Resubdivision. R. Raphael confirmed that the Petitioner is using the correct numbering convention. The Petitioner is seeking to create a new subdivision which uses its own numbering. M. Jablonski stated that the proposed "Lot #2" for the new proposed subdivision is separate from the existing "Lot 92" from the existing subdivision. Commissioner Geinosky asked about landscaping. J. Armando stated that landscaping will be provided in accordance with the submitted landscape plan. Commissioner Gemosky asked about the variations for loading spaces. M. Jablonski stated the second variation is the elimination of the required loading space. The Petitioner indicated that all deliveries will be made in off -hours, and can be made using existing parking stalls. Item 28: PC Docket # 22-5 — Petition for rezoning 490 and 500 Bennett Road from I-1 (industrial District) to I'iC (Innovation and Technology Center District) Chairman Glass read the legal notice into the record and asked the Petitioner to explain their purpose before the Plan Commission. M. Houser explained the intent of the project is to demolish the existing buildings at 490 and 500 Bennett Road and create a service road for truck traffic to 75 Northwest Point Boulevard, in addition to a dry stormwater detention basin. He explained car traffic will use Northwest Point Boulevard. He stated Bridge Industrial would like to rezone 490 and 500 Bennett Road parcels from I-1 (Industrial District) to ITC (Innovation and Technology Center District) and consolidate the properties into 75 Northwest Point Boulevard. This consolidation is a Village requirement. Chairman Glass asked why Bridge Industrial needs the properties for stormwater management. M. Houser stated the Petitioner is primarily using the land for truck access and is using the excess land as stormwater management. Commissioner Bacigalupo asked for the intended purpose of the building at 75 Northwest Point Boulevard. M. Houser explained that the expected construction at 75 Northwest Point Boulevard is meant for offices or a combination of office, R&D, manufacturing, and warehouse use. M. Jablonski stated that the proposed construction at 75 Northwest Point meets the zoning requirements for the ITC district. Commissioner Bacigalupo asked the Petitioner if Bridge Industrial would ewer subdivide the building into multiple tenants. M. Houser stated Bridge Industrial is targeting Higher end office, R&D, and manufacturing businesses. Commissioner Carlson asked for clarification on the proposed stormwater basin. M. Houser explained Bridge Industrial will meet the MWRD requirements to provide a dry stormwater detention basin with plants. Commissioner Weiner asked when construction will begin. M. Houser stated construction will begin next month. Commissioner Weiner asked when construction will end. M. Houser stated the anticipated end date is mid-2023. Commissioner Geinosky asked when construction at 75 Northwest Point Boulevard is expected to end. M. Houser stated construction is expected to end by mid-2023. Chairman Glass opened questions to the audience. J. Hubbard stated his company at 520 Bennet Road uses the existing drives/ parking areas at 490 and 500 Bennett Road to maneuver their trucks. J. Hubbard asked if his company would be able to request use of the proposed service road J. Hubbard stated his company has no opposition to the development. Chairman Glass stated that is a private matter to be resolved between J. Hubbard and Bridge Industrial. Z. Ordenic stated he owns the company at 550 Bennett Road and his building floods when it rains, about once a year. He stated he is concerned that the new development at 75 Northwest Point Boulevard will make the flooding problem worse. Chairman Glass explained that the development cannot allow for an increase Of stormwater flow_ Z_ Ordenic asked what kind of tragic increases are expected with the new development_ He stated his employees park along Bennett Road and he is concerned that the new development would increase traffic and pose a safety issue to pedestrians- Chauman Glass explamed that traffic to the 5 t. RECONUKENDATION Commissioner Geinosky moved to recommend approval of the following: Rezoning of the properties at 490 Bennett Road and 500 Bennett Road from I- I (Industrial District) to Innovation and Technology Center District (ITC). Commissioner Schumm seconded the motion. Upon voting (Glass, Carlson, Weiner, Morrill, Bacigalupo, Rettberg, AYES) the motion carried unanimously. Item 2C: New Memo Format C. Gabiga informed the members of the Plan Commission that staff will be re -formatting the memo for Plan Commission meetings in a way that provides context and detail. The new memo will feature a new layout intended to more clearly present the purpose of the petition along with the review standards for consideration.
