Hinkle, Plan Reviewer, Community Development Zoning Variation — Docket #22-11 201 Parkchester Road Acting Chairman Romanski called the meeting to order at 7:00 p.m. and read a statement describing the hearing notification procedure as well as the legal notice. Section 7A-1 (13)(2)(b): states that fences greater than four feet (4') in height and not more than six feet (6') in height, may be located not closer than ten feet (10') to the street side property line between the front edge of the house and the rear edge of the house. The petitioner is requesting to install a six foot (6') high fence between the front edge of the house and the rear edge of the house which will be located approximately seven feet (7') from the property line where it will attach to an existing approved fence located approximately seven feet (7') from the property line. There currently is no fence in this location. The petitioner, David Nawara, was sworn in and asked to present his case. Mr. Nawara, (Owner of Record), stated that his property currently has an existing backyard layout with a concrete deck and pool leaving no grass area to place a playground or an open area for his newborn son to play in. Acting Chairman Romanski opened the meeting to questions from the board. Member Spragg asked what material was proposed for the fence and if it would be painted or stained. The petitioner responded that it would be a cedar stained fence. Acting Chairman Romanski asked how long has the pool been present and if any of the neighbors had any issues with the new fence being installed. The petitioner responded that the pool has been there since they purchased the home in 2015 and if the board would like, he could gather signatures of his neighbors for approval. No neighbors had communicated that they objected to the fence. Acting Chairman Romanski stated that there would be no visibility issues with the installation of the proposed fence. Community Development staff received one inquiry requesting information on this variation with no objections. Community Development staff had no comments. Acting Chairman Romanski called for the motion. A Motion to DO GRANT a variance to permit a six foot (6') high fence between the front edge of the house and the rear edge of the house which will be located approximately seven feet (7') from the property line where it will attach to an existing approved fence located approximately seven feet (7') from the property line was made by Member Glimco which was seconded by Member Rawleigh. Upon voting (AYES — Bookler, Damptz Jr., Glimco, Rawleigh, Romanski, Spragg) (NAYES — None) (ABSENT — Childress, Latrofa, Serrano) The motion carried. Acting Chairman Romanski called for a motion to adjourn.
