AN ORDINANCE GRANTING A VARIATION OF THE ZONING ORDINANCE
OF THE VILLAGE AS IT PERTAINS TO ALLOWABLE LOCATIONS FOR
SWIMMING POOLS (FORMERLY SECTION 3.54D) TO PERMIT AN
EXISTING SWIMMING POOL WHICH WOULD ENCROACH ONE (1') FOOT
INTO THE REQUIRED SIDEYARD ON PROPERTY LOCATED AT
590 SYCAMORE DRIVE, ELK GROVE VILLAGE (GALLAGHER)
WHEREAS, the Zoning Board of Appeals at a public meeting duly
called and held according to law considered the question of grant-
ing a one (1') foot variation to permit an existing swimming pool
to encroach in the required sideyard; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village, after having considered the recommendation
of the Zoning Board of Appeals to not grant the variation, but
in further consideration of the compliance with electrical regu-
lations and other considerations find and believe that sufficient
hardship exists so as to justify the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That there be granted a variation of the Zoning
Ordinance as it pertains to allowable locations for swimming pools
to permit an existing swimming pool to encroach one (l') foot into
the required sideyard on property located at 590 Sycamore Drive,
Elk Grove Village and legally described as follows:
Lot 2509 in Elk Grove Village, Section S, being a
Subdivision in the South h of Section 33, Township
41 North, Range 11, East of the Third Principal Meri-
dian, in Cook County, Illinois
Section 2: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
PASSED this 11th day of April 1995.
