HomeMy WebLinkAboutORDINANCE - 2430 - 5/23/1995 - SPECIAL USE & VARIATION/2700 GREENLEAFORDINANCE NO. 2430 AN ORDINANCE GRANTING A SPECIAL USE PERMIT AND A VARIATION OF THE ZONING ORDINANCE TO GTE AIRFONE, INC. TO PERMIT THE CONSTRUCTION OF AN EIGHTY (80') FOOT COMMUNICATION TOWER ON PROPERTY LOCATED AT 2700 GREENLEAF AVENUE, ELK GROVE VILLAGE WHEREAS, the Zoning Board of Appeals and the Plan Commission of the Village of Elk Grove Village at public meetings duly called and held according to law considered the question of granting a variation of the Zoning Ordinance as it pertains to structures in side yards and the issuance of a Special Use Permit to permit a communication tower eighty (80') feet in height respectively; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having reviewed the recommendations and finding of said Zoning Board of Appeals and Plan Commission find and believe that sufficient hardship exists to justify the grant- ing of the requested variation and that the granting of the Spe- cial Use Permit would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section l: That there be granted a variation of Section 3-6:D.2 as it pertains to structures in yards and the granting of a Special Use Permit so as to permit the construction of an eighty (80') foot communication tower that would be located within the required side yard, approximately four (4') feet from the side lot line on pro- perty located at 2700 Greenleaf Avenue and legally described as follows: Lot 3 in Rogers Industrial Subdivision Unit 5, being a Subdivision in the Northwest Quarter of Section 36, Township 41 North, Range 11, East of the Third Prin- cipal Meridian, in Cook County, Illinois. Section 2: That this variation and the issuance of a Spe- cial Use Permit is subject to the petitioner GTE Airfone, Inc. sub- mitting a Performance Bond, naming the Village of Elk Grove Village as a guaranteed party thereunder, in the amount of $10,000.00 for the disassembly of said tower and the restoration of the property to its current state should the tower be abandoned by the petitioner at some time in the future. Said Performance Bond shall be in a form and manner that is acceptable to the Village of Elk Grove Village and approved by the Village Attorney. Section 3: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this 23rd day of 1995. APPROVED this 23rd day of May , 1995.
