HomeMy WebLinkAboutORDINANCE - 2432 - 5/23/1995 - SITE PLAN, AMENDED/GRANT VARIATIONORDINANCE NO. 2432 AN ORDINANCE AMENDING ORDINANCE NO. 1780 BY APPROVING AN AMENDED SITE PLAN AND FURTHERMORE GRANTING A VARIATION OF THE ZONING ORDINANCE TO PERMIT MORE THAN ONE PRINCIPAL BUILDING ON A LOT OF RECORD FOR PROPERTY LOCATED AT BIESTERFIELD AND WELLINGTON AVENUE, ELK GROVE VILLAGE (GUILD DEVELOPMENT CORPORATION WHEREAS, the Plan Commission and the Zoning Board of Appeals of the Village of Elk Grove Village at a joint public hearing and a subsequent independent hearing considered the question of amend- ing the Site Plan for property located on Biesterfield Road approxi- mately one hundred (100') feet East of Wellington Avenue, which Site Plan was previously approved pursuant to Ordinance No. 1780; and furthermore considered the granting of a variation to permit more than one principal building on a zoned lot; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having reviewed the recommendation and finding of said Plan Commission and Zoning Board of Appeals find and believe that it is in the best interest of the Village to ap- prove the Amended Site Plan as submitted and as amended by the Plan Commission and to grant the variation to permit more than one principal building on a zoned lot. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the Site Plan for property located on Biester- field Road one hundred (100') feet of Wellington, which Site Plan was previously established pursuant to Ordinance No. 1780, be and the same is hereby amended and the Site Plan submitted to the Plan Commission and to the Village Board, three (3) copies of which are on file in the Office of the Village Clerk, is hereby approved for said property, which property is legally described as follows: The West 442.5 feet (as measured along the South line on the North 15 acres of the Northwest a of the North- east a of Section 32) of the Northwest a of the North- east a (except the North 15 acres thereof) of Section 32, Township 41 North, Range 11, East of the Third Prin- cipal Meridian, in Cook County, Illinois, except that part used or dedicated for Biesterfield Road, and that part taken for Road in Case 71 L 15920 Section 2: That there be granted a variation of the Zoning Ordinance of the Village to permit more than one principal build- ing on a zoned lot as depicted on the approved Amended Site Plan approved in Section 1 of this Ordinance. Section 3: That all other provisions of Ordinance No. 1780 with respect to the subject property shall remain in full force and effect including the prohibition of a restaurant on Outlot 2 of the subject property. Section 4: That all rooftop HVAC units be sufficiently screened in order to be properly soundproofed and not readily viewable from any area of the shopping center. -2- Section 5: This Ordinance shall be in full force and effect from and after its passage and approval according to law.
