HomeMy WebLinkAboutORDINANCE - 2434 - 6/13/1995 - REZONE/VACANT PROPERTY ON BIESTERFIELDORDINANCE NO. 2434 AN ORDINANCE REZONING OUTLOT #1 OF THE VACANT PROPERTY LOCATED ON BIESTERFIELD ROAD, APPROXIMATELY 110 FEET EAST OF WELLINGTON AVENUE, FROM B-2 GENERAL BUSINESS TO B-3 AUTOMOTIVE ORIENTED BUSINESS (GULLO DEVELOPMENT CORPORATION) WHEREAS, the Plan Commission of the Village of Elk Grove Vil- lage at a public hearing duly called and held according to law considered the question of granting a rezoning to Outlot #1 of that property located on Biesterfield Road approximately 110 feet of Wellington Avenue and legally described hereinafter; and WHEREAS, the President and Board of Trustees after having considered the recommendation of said Plan Commission find and believe it is in the best interest of the Village to grant the rezoning as requested. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That outlot #1 of certain vacant property located on Biesterfield Road approximately 110 feet East of Wellington Avenue, which property is legally described on Exhibit A attached hereto, be and the same is hereby rezoned from B-2 General Busi- ness District to the B-3 Automotive Oriented Business District. Section 2: That the Village Clerk is hereby directed to amend the Official Zoning Map of the Village to incorporate the changes set forth herein. Section 3: That the property as rezoned shall permit a drive- thru restaurant as approved by the President and Board of Trustees pursuant to upscaled pictorial exhibits and testimony of the Gullo Development Corporation and the Taco Bell Corporation and shall be further subject to the following conditions: A. That no neon flags, posters, or banners be hung in or on the Taco Bell windows or property; and B. That the entire development include additional land- scaping over and above what is required by Village Ordinance with the proposed landscape plan to be reviewed by staff with a report to be presented to the Village Board; and C. That signage on the building utilize separate back -lit lettering. Section 4: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. EXHIBIT A LOT ONE Beginning at the Southeast corner of a recorded parcel described as: The West 442.5 feet (as measured along the South line of the North 15 acres of the Northwest a of the Northeast ; of Section 32) of the Northwest , of the Northeast ; (except the North 15 acres thereof) of Section 32, Township 41 North, Range 11, East of the Third Principal Meridian, except that part dedicated for Biesterfield Road, and that part taken for road in Case 71 L 15920; thence Westerly on the North line of Biesterfield Road as widen, 150.55 feet to a point of said North line of Biesterfield Road; thence Northerly on a line parallel to the West line of the North- west a of the Northeast , of Section 32-41-11, 200 feet; thence Easterly on a line perpendicular to the West line of the North- west ; of the Northeast ; of Section 32-41-11, 150 feet to a point of the East line of the above parcel; thence Southerly on the East line of the recorded parcel, 201.43 feet to the point of beginning at the Southeast corner of the recorded parcel.
