AN ORDINANCE GRANTING A VARIATION OF SECTION 8 -12B -1-1D,
EASEMENTS OF THE MUNICIPAL CODE TO PERMIT A SWIMMING
POOL TO ENCROACH TWO (2') FEET INTO A PUBLIC UTILITY
AND DRAINAGE EASEMENT ON PROPERTY LOCATED AT
1495 MORGAN DRIVE, ELK GROVE VILLAGE (LAUBE)
BE IT ORDAINED, by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage,
Illinois as follows:
Section 1: That there be granted a variation of Section 8-
12B -1-1D, Easements of the Municipal Code to permit a swimming
pool to be located two (2') feet within a ten (10') foot public
utility and drainage easement on property located at 1495 Morgan
Drive, Elk Grove Village subject to the condition that should the
Village of Elk Grove Village, in the future, need to utilize the
entire easement the Village shall have the right to terminate this
variation and have the property owner restore the easement area
to the condition that existed prior to the construction of the
pool.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
