AN ORDINANCE GRANTING A VARIATION OF SECTIONS 3.54A AND 5.1
OF THE ZONING ORDINANCE PERTAINING TO STRUCTURES IN REQUIRED
YARDS TO PERMIT THE CONSTRUCTION OF AN ATTACHED GARAGE ON PROPERTY
LOCATED AT 85 SHELLEY COURT, ELK GROVE VILLAGE (BISCEGLIE)
WHEREAS, the Zoning Board of Appeals at a public meeting duly
called and held according to law considered the question of granting a
variation of Sections 3.54A and 5.1 of the Zoning Ordinance as they
pertain to required yards to permit the construction of an attached
garage which would encroach between two (2) and eleven (11) feet into
the required rear yard on property located at 85 Shelley Court, Elk
Grove Village and legally described hereinafter; and
WHEREAS, the President and Board of Trustees of the Village of Elk
Grove Village after having considered the recommendation and finding of
said Zoning Board of Appeals find and believe that sufficient hardship
exists so as to justify the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That there be granted a variation of Sections 3.54A
and 5.1 of the Zoning Ordinance of the Village of Elk Grove Village
pertaining to structures in required rear yards to permit the
construction of an attached garage which would encroach between two (2)
and eleven (11) feet into the required rear yard on property located at
R5 Shelley Court, Elk Grove Village and legally described as follows:
Lot 4720 in Elk Grove Village Section 16, being a
Subdivision in the South half of Section 29,
Township 41 North, Range 11, East of the Third Principal
Meridian, in Cook County, Illinois.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
VOTE: AYES: 4 NAYS: 0 ABSENT: 2
