AN ORDINANCE GRANTING A VARIATION OF SECTIONS 3.55B(2) AND 3.94B
OF THE ZONING ORDINANCE PERTAINING TO THE SURFACE REQUIREMENT
FOR THE PARKING OF VEHICLES TO PERMIT THE PARKING AND STORING
OF BOATS AND/OR BOAT TRAILERS IN THE REAR YARD ON PROPERTY
LOCATED AT 1200 EAST HIGGINS ROAD, ELK GROVE VILLAGE
(NELSON MARINE)
WHEREAS, the Zoning Board of Appeals at a public hearing duly
called and held according to law to consider the question of grant-
ing the Petition for Variation (Docket No. 94-2) for a variation
of Sections 3.55B(2) and 3.94E of the Zoning Ordinance duly filed
by Nelson Marine, Inc. ("Owners") in order to permit the parking
of boats and boat trailers on a stone and gravel area in the rear
yard on property located at 1200 East Higgins Road, and legally
described hereinafter; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village after having considered the recommendation
of said Zoning Board of Appeals find and believe that sufficient
hardship exists so as to grant a conditional variation of Sections
3.55B(2) and 3.94B of the Zoning Ordinance.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That there be granted a variation of Sections
3.55B(2) and 3.94B of the Zoning Ordinance to permit the parking
and storing of boats and tow -type boat trailers on the existing
stone and gravel area in the rear yard of property located at 1200
East Higgins Road (the "Subject Area") and legally described as
follows:
Tract 1: The North 72 feet of the following described
Parcel:
That part of the Southeast quarter of Section 22, Town-
ship 41 North, Range 11, East of the Third Principal
Meridian, described by commencing at the Northwest corner
of said Southeast quarter and running thence South along
the West line of said Southeast quarter, 970.20 feet to
the South line of the North 971.0 feet of said South-
east quarter as monumented and occupied; thence North
89 degrees 21 minutes 46 seconds East along said South
line, 520.55 feet for a place of beginning; thence con-
tinuing North 89 degrees 21 minutes 46 seconds East
along said South line, 128.45 feet; thence South par-
allel with said West line of the Southeast quarter, 285.93
feet to the Northerly right of way line of Higgins Road;
thence North 79 degrees 11 minutes 38 seconds West along
said right of way line, 126.62 feet to a point of inter-
section with the center line of a party wall extended
Southerly; thence North 0 degrees 37 minutes 11 seconds
West along said extension and said center line, 81.18
feet; thence South 89 degrees 22 minutes 49 seconds West
along said center line, 1.25 feet; thence North 0 de-
grees 37 minutes 11 seconds West along said center line
and said center line extended Northerly 179.61 feet to
the place of beginning, in Cook County, Illinois
Tract 2: The North 53 feet of the following described
Parcel:
That part of the Southeast quarter of Section 22, Town-
ship 41 North, Range 11, East of the Third Principal
Meridian, described by commencing at the Northwest corner
of said Southeast quarter and running thence South along
the West line of said Southeast quarter, 970.20 feet to
the South line of the North 971.0 feet of said South-
east quarter as monumented and occupied; thence North
89 degrees 21 minutes 46 seconds East along said South
line, 649.0 feet for a place of beginning; thence con-
tinuing North 89 degrees 21 minutes 46 seconds East
along said South line, 40.0 feet; thence South parallel
with said West line of the Southeast quarter 294.0 feet

to the Northerly right of way line of Higgins Road;
thence North 79 degrees 11 minutes 38 seconds West along
said right of way line, 40.72 feet; thence North par-
allel with said West line of the Southeast quarter,
285.93 feet to the place of beginning, in Cook County,
Illinois
Section 2: That this variation shall automatically terminate
September 30, 1998 provided that the owner shall make yearly depo-
sits of Ten Thousand ($10,000.00) Dollars on or before March 31,
1995, 1996, 1997 and 1998 with the Elk Grove Village branch of Citi-
bank, 850 Arlington Heights Road, to be held in escrow and ultimately
used for the paving of the Subject Area. Owners shall furnish the
Village Manager with a copy of the receipt Citibank issues for each
deposit. If the owner fails to make such deposits and/or the Vil-
lage is not notified thereof, then this variation shall automati-
cally be terminated. Owner shall complete the resurfacing of the
Subject Area in accordance with the Sections by no later than Sep-
tember 30, 1998, pursuant to an appropriate Village building permit.
If, for any reason, the resurfacing does not occur or the resurfac-
ing project is abandoned, subsequent to the time yearly deposits
have commenced, then, and in that event, the escrow deposit account
shall be closed and the proceeds thereof shall be be equally di-
vided between Onwers and the village.
Section 3: That the Village Clerk is authorized to record
this Ordinance with the Recorder of Deeds of Cook County, Illinois.
Section 4: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
