HomeMy WebLinkAboutORDINANCE - 2397 - 12/13/1994 - ZONING VARIATION, 945 CASS LNORDINANCE NO. 2397 AN ORDINANCE GRANTING A VARIATION OF SECTION 5.1 OF THE ZONING ORDINANCE AS IT PERTAINS TO THE USE OF YARDS FOR STRUCTURES TO PERMIT THE CONSTRUCTION OF A FIREPLACE IN THE REQUIRED EIGHT (8') FOOT SIDE YARD AREA ON PROPERTY LOCATED AT 945-CASS LANE, ELK GROVE VILLAGE (FILMORE) WHEREAS, the Zoning Board of Appeals at a public meeting duly called and held according to law considered the question of grant- ing a variation of Section 5.1 of the Zoning Ordinance to permit the construction of a fireplace which would enfringe one (1) foot six (6) inches into the required eight (8) foot side yard on pro- perty located at 945 Cass Lane and legally described hereinafter; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having considered the recommendation and finding of said Zoning Board of Appeals find and believe that sufficient hardship exists so as to justify the granting of said variation. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 5.1 of the Zoning Ordinance, as it pertains to the use of yards for structures, to permit the construction of a fireplace which will enfringe one (1) foot six (6) inches into the required eight (8) foot side yard on property located at 945 Cass Lane, Elk Grove Village and legally described as follows: Lot 63 in Parkview Heights Subdivision, being a Sub- division in the Northeast Quarter of Section 36, Town- ship 41 North, Range 10, East of the Third Principal Meridian, in Cook County, Illinois. Section 2: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this 13th day of December , 1994.
