HomeMy WebLinkAboutORDINANCE - 2398 - 12/13/1994 - GROVE MALL/CONDEMNATION/BLIGHTEDORDINANCE NO. 2398 AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY THROUGH CONDEMNATION OR OTHERWISE IN ORDER TO ELIMINATE THE BLIGHTED CONDITIONS EXISTENT THEREON WHEREAS, the Village of Elk Grove Village is a Home Rule Unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, the Village pursuant to Ordinance No. 2374 has de- clared the Grove Mall Shopping Center to be a blight area as de- fined in Section 8-13-1 et seq. of the Village Code; and WHEREAS, in order to abate the existing blight it is deemed advisable and necessary to acquire the Grove Mall Shopping Center, which property is legally described on Exhibit A. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That under the authority vested in the Corporate Authorities of the Village of Elk Grove Village through Section 8-13-1 et. seq. of the Village Code and the Home Rule powers and other ordinances of the Village of Elk Grove Village, it is hereby necessary and desirable that the Village acquire title to and pos- session of the real property legally described on Exhibit A for the purpose of eliminating the blight which presently exists on that property and redeveloping same in the best interest of the Village. Section 2: That the Village Attorney and such consulting attorney as designated by the Village Attorney, be and are hereby authorized, empowered and directed to negotiate personally or through its representatives for and on behalf of the Village with the owner or owners of the subject property for the purchase thereof by the Village. Section 3: That in the event the Village Attorney is unable to agree with the owners of the subject property as to the compen- sation to be paid therefor, then fee simple title to and possession of the subject property shall be acquired by the Village of Elk Grove Village through condemnation and the Village Attorney is au- thorized to appoint the law offices of Burke & Ryan as additional attorneys for the Village, which firm is further authorized, em- powered and directed to institute proceedings in any court of com- petent jurisdiction to acquire fee simple title to and possession of said subject property for the Village of Elk Grove Village in accordance with the eminent domain laws of the State of Illinois and the ordinances of the Village of Elk Grove Village. Section 4: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. -2- Section 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
