HomeMy WebLinkAboutORDINANCE - 2285 - 1/26/1993 - VILLAGE CODE/SEVERAL CORRECTIONS0 ORDINANCE NO. 2285 AN ORDINANCE MAKING SEVERAL CORRECTIONS TO THE NEW OFFICIAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE ADOPTED MAY 12. 1992 WHEREAS, the Village of Elk Grove Village by Ordinance duly passed and approved on the 12th day of May, 1992 adopted an Amended Official Code of the Village of Elk Grove Village; and WHEREAS, subsequent to the adoption of said Official Code several omissions and corrections were discovered by various de- partments within the Village. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Section 1-4-4-1 B. of Title 1 of the Official Code be amended by changing the name of the offense after Section 3-703 to read as follows: "3-703 Improper use of registration or title" Section 2: That Section 1 -7D -1-B.-1 of Title 1 of the Official Code be amended to read as follows: "1. Legal Advisor: The Attorney shall be the legal advisor of the Village and shall render advice on all legal questions affecting it whenever requested to do so by any Village official. Upon request by the Village President or the Village Manager he shall reduce any such opinion to writing." Section 3: That Section 1 -7A -6-I. of Title 1 of the Official Code be amended to read as follows: "I. Direct and supervise the purchase of all materials, supplies and equipment for which funds are provided in the budget for amounts up to and including five thousand dollars ($5,000.00). For expenditures in excess of five hundred dollars ($500.00) and up to five thousand dollars ($5,000.00), secure at least two (2) quotations before making purchases, and if called upon by the Board of Trustees, be pre- pared to present the quotations. Receive sealed bids for purchases or contracts in excess of five thousand dollars ($5,000.00) and present them to the Board of Trustees for approval and advise the Board on the advantages or disadvantages of con- tract and bid proposals. No purchase shall be made, contract let or obligation incurred for any item or service which exceeds the current working budget without prior approval by the Board of Trus- tees. No contract in excess of five thousand dol- lars ($5,000.00) and no contract for new construc- tion shall be let except by the Board of Trustees. The Village Manager may issue such rules governing purchasing procedures for the Village as the Board of Trustees shall approve." Section 4: That Section 1-7A-6 C. of Title 1 of the Official Code be amended to read as follows: "C. At the end of the fiscal year, direct and super- vise the preparation and submission to the Board of Trustees of a complete report on the finances and administrative activities of the Village for the preceeding year." Section 5: That Section 2-10-4 C. of Title 2 of the Official Code be amended to read as follows: I.C. Upon the approval of the President and Board of Trustees of the aforementioned program and budget, the Community Service Board, under the direction of the Village Manager, shall administer the Com- munity Service Program for the Village in accor- dance with approved contracts, and Village per- sonnel, purchasing and budget procedures, and State law." -2- N Section 6: That Section 2-2-2 A. of the Official Code be and the same is hereby amended to read as follows: "A. The Board of Health shall review the program of the office of Health Services and make recommen- dations with respect thereto and have such other powers and perform the duties assigned to it by statute, ordinance or direction of the President and Board of Trustees." Section 7: That Section 3-9B-3 APPLICATION FOR CERTIFICATE of the Official Code be amended by deleting subparagraphs B. and F. and relettering the remaining paragraphs from A. through M. to A. through K. respectively; and further amending the first sentence of the last paragraph of said Section to read as follows: "The Village Clerk shall cause to be kept in the office of the Village Clerk an accurate record of every ap- plication received and acted upon together with all other info'rmation and data pertaining thereto and all certificates of registration issued under the provi- sions of this Article and of the denial of applications." Section 8: That Section 6-3-7-1 B. of Title 6 of the Official Code be amended to read as follows: "B. Application for License; Issuance: Application for bicycle licenses shall be made to the Police Department. At the time of such application, the owner or operator shall furnish the Police Depart- ment with the following information: 1. Name and address of owner and/or operator of bicycle. 2. Make of bicycle. 3. Color, size and type of bicycle. 4. Manufacturer's serial number, if any. -3- Upon application as herein provided, the Police Department shall issue or cause to be issued a sticker bearing the words "Elk Grove Village Illi- nois Bicycle License" and the license number as- signed to the bicycle." Section 9: That Section 6-3-7-1 C. of Title 6 of the Official Code be amended to read as follows: "C. Sticker: 1. The owner or operator cause the license sticker, issued by the Police Department, to be firmly at- tached under the seat of the bicycle for which is- sued, in such position as to be plainly visible. 2. Loss of license or bicycle with license attached shall be reported immediately to the Police Depart- ment. 3. No person shall remove a license sticker from a bicycle except upon a transfer of ownership or in the event the bicycle is dismantled and no longer operated upon any street in this Village. 4. Upon the sale or other transfer of a licensed bicycle, the licensee shall remove the license sticker." Section 10: That Section 6-6-8 PENALTIES of Title 6 of the Official Code be renumbered to 6-6-9 and a new 6-6-8 be added, which Section shall read as follows: "6-6-8: RULES FOR USE OF VILLAGE PARKS: A. Dogs: No person shall bring or lead any dog into any park in the Village. B. Weapons; Missiles: 1. All persons are forbidden from throwing stones or rocks in any public park in the Village. -4- 2. No person shall use a BB gun, slingshot or other device propelling a missile in any Village park. C. Motor Vehicles: No person shall drive or ride in a motor driven vehicle in any public park in the Village unless autho- rized by the Park District. D. Liquor; Intoxicated Persons: No intoxicated person shall enter, be or remain in any public park nor shall any person bring into, sell, give away, or drink any alcoho- lic beverage in any public park in the Village. E. Golf; Bows and Arrows: No person shall play golf or propel a golf ball or use bows and arrows in any public park in the Village." Section 11: That Section 7-5-6 PENALTIES of Title 7 of the Official Code be and the same is hereby amended to read as follows: "7-5-6: PENALTIES: Any person violating any provisions of this Article shall be fined not less than one thousand dollars ($1,000.00) nor more than ten thousand dollars ($10,000.00) for each offense, and a separate offense shall be deemed committed on each day during or which a violation occurs or continues. In addition to any such penalty, any person violating any provisions of this Article shall be required to reimburse the Village for all costs incurred by the Village relating to the clean up of sanitary sewers following a discharge of prohibited or illegal material." Section 12: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 13: That this Ordinance shall be in full force and effect from and after its passage, approval and publication ac- cording to law. -5- VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 26th day of January , 1993.
