HomeMy WebLinkAboutORDINANCE - 2314 - 7/13/1993 - SPECIAL USE/GREENLEAF/BUSSEORDINANCE NO. 2314 AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO THE CHICAGO TITLE AND TRUST COMPANY AS TRUSTEE UNDER TRUST NO. 1080700 (HARDEE'S RESTAURANT) TO PERMIT THE OPERATION OF A RESTAURANT IN AN I-2 ZONED DISTRICT AT THE SOUTHEAST CORNER OF GREENLEAF AVENUE AND BUSSE ROAD, ELK GROVE VILLAGE WHEREAS, the Plan Commission of the Village of Elk Grove Village, acting as a Zoning Commission, at a public hearing duly called and held according to law considered the question of grant- ing a Special Use Permit in accordance with Section 5.82 of the Zoning Ordinance to permit the operation of a Hardee's Food Sys- tems, Inc. restaurant in I-2 Zoned District on property located at the Southeast corner of Greenleaf Avenue and Busse Road and legally described hereinafter; and WHEREAS, the President and Board of Trustees after having reviewed the recommendation of said Plan Commission find and be- lieve it to be in the best interest of the Village that said Spe- cial Use Permit be granted subject to the changes and amendments suggested by the Plan Commission and as set forth in the Revised Site Plan of the Petitioner. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a Special Use Permit to Chicago Title and Trust Company as Trustee under Trust No. 1080700 and Hardee's Food Systems, Inc. to permit the operation of a fast food drive-thru restaurant on property located at the Southeast corner of Greenleaf Avenue and Busse Road and legally described as follows: Lot 19 (except the East 553.10 feet thereof) in Centex Industrial Park, Unit Number 4, being a Subdivision in Section 35, Township 41 North, Range 11, East of the Third Principal Meridian, (excepting therefrom that part taken for widening of Greenleaf Avenue) in Cock County, Illinois Section 2: That the Special Use Permit granted herein shall be subject to compliance and adherence to the Site Plan prepared by William K. Olson and Associates dated May 24, 1993 and the re- vision thereto dated June 21, 1993, three copies of said Site Plan being on file in the Office of the Village Clerk. Section 3: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 13th day of July , 1993.
