AN ORDINANCE GRANTING A VARIATION OF SECTION 8-4-4 B3
OF THE VILLAGE CODE TO PERMIT A TWENTY-FOUR HOUR
ILLUMINATED WALL SIGN AT THE EAGLE COUNTRY WAREHOUSE,
801 MEACHAM ROAD, ELK GROVE VILLAGE
WHEREAS, Eagle Country Warehouse operates a retail grocery
business in the Village of Elk Grove Village on a twenty-four (24)
hour per day basis, which establishment is adjacent to residential
zoned areas in the Village; and
WHEREAS, the Village Sign ordinance, as it relates to illumi-
nated signs, presently prohibits illuminated signs to be in opera-
tion after 1:00 a.m. on commercial property adjacent to residential
zoned districts; and
WHEREAS, prohibiting illumination of the identification sign
after 1:00 a.m. would have a deleterious effect on the viability
of Eagle Country Warehouse to do business after the hour of 1:00
a.m.; and
WHEREAS, Eagle Country Warehouse has petitioned the Village
to permit a twenty-four (24) hour per day illuminated sign sub-
ject to the condition that the illumination be reduced fifty (508)
percent between the hours of 10:00 p.m. and 6:00 a.m. and further
subject to the provision that if such variation is granted the
Village may reserve the right to further alter, modify or change
the conditions of the variation in light of its effect on abuting
residential homes.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Section
8-4-4 B3 of the Village Code permitting the operation of a twenty-
four hour per day illuminated sign at Eagle Country Warehouse,
801 Meacham Road, Elk Grove Village subject to the following con-
ditions:
A. The intensity of the illumination must be reduced
by fifty percent (508) between the hours of 10:00
p.m. and 6:00 a.m.
B. Should the variation, as granted, result in a situ-
ation which has a negative impact on abutting resi-
dential owners, the Village reserves the right to
modify the variation herein granted in such a manner
that is in the best interest of the Village and its
residents and the Eagle Country Warehouse acknow-
ledges the Village's authority in this regard.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.
