HomeMy WebLinkAboutORDINANCE - 2307 - 6/8/1993 - ZONING VARIATION, MALLARD CROSSINGORDINANCE NO. 2307 AN ORDINANCE GRANTING A VARIATION OF SECTION 5.54 (EXHIBIT F) OF THE ZONING ORDINANCE OF THE VILLAGE TO PERMIT SEVENTY (700) ANGULAR PARKING OF THE EAGLE FOOD STORE PORTION OF THE MALLARD CROSSING SHOPPING CENTER (HAMILTON PARTNERS) WHEREAS, the Zoning Board of Appeals of the Village of Elk Grove Village at a public meeting duly called and held according to law considered the question of granting a variation of Section 5.54 (Exhibit F) to permit seventy (70°) degree angular parking on the Eagle Country Warehouse of the Mallard Crossing Shopping Center, legally described hereinafter; and WHEREAS, the President and Board of Trustees of the Village after considering the recommendation and finding of said Zoning Board of Appeals find and believe that sufficient hardship exists so as to grant the variation requested subject to the right of the Village to reconsider the granting of this variation in the future, or make modifications thereto. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 5.54 (Exhibit F) of the Zoning ordinance to Mallard Cross Shopping Cen- ter (Hamilton Partners) to permit seventy (700) degree angular parking with two-way traffic aisles for the Eagle Country warehouse portion of the Mallard Cross Shopping Center without modifying the stall to stall interlock dimension, the lengths of the parking aisles, and the location and configuration of the landscape is- lands of said Center subject to the condition that the Village, in its discretion, shall have the right to review for the purpose of terminating or modifying the variation granted herein depending in the impact of said variation on the shopping center as a whole The right to review shall be perpetual subject to the right of the owner to provide input to the Board with respect to all issues concerning a termination or modification of the variation granted herein, for property legally described as follows: Lot 2 in Meacham/Nerge Subdivision, being a Subdi- vision of part of the East 11 of the Northwest '-:, of Section 38, Township 41 North, Range 10, East of the Third Principal Meridian, in Cook County, Illi- nois. Section 2: That the Site Plan originally approved for the Mallard Crossing Shopping Center is hereby amended to conform with the variation granted herein, three copies of said amended Site Plan are on file with the Village Clerk. Section 3: That this Ordinance shall be in full force and effect subject to its passage and approval according to law. VOTE: AYES: 4 NAYS: ABSENT: 0 PASS: 1 PASSED this 8th day of June 1993.
