HomeMy WebLinkAboutORDINANCE - 2972 - 1/13/2004 - ZONING VARIATION/1300 LUNT AVENUEORDINANCE NO. 2972 AN ORDINANCE GRANTING A VARIATION OF SECTION 3-7.D.3 AND 3-7:E-9 PERTAINING TO THE LOCATION OF A FENCE IN AN 1-2 RESTRICTED INDUSTRIAL DISTRICT TO PERMIT THE CONSTRUCTION OF A SEVEN (7) FOOT HIGH CHAIN LINK FENCE ON PROPERTY LOCATED AT 1300 LUNT AVENUE ELK GROVE VILLAGE (GULLO INTERNATIONAL DEVELOPMENT CORPORATION) WHEREAS, the Zoning Board of Appeals, at a public hearing duly called and held according to law, considered the question of granting a variation of Section 3- 7:D.3 and Section 3-7.E-9 of the Zoning Ordinance pertaining to fence locations in an 1-2 Industrial Zoned District to permit the construction of a seven (7) foot high chain-link fence that would be located approximately thirty -rive (35) feet beyond the nearest front comer of the principal building and encroach approximately rive (5) feet into the required twenty-five (25) foot front yard on property located at 1300 Lunt Avenue, Elk Grove Village; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation and finding of said Zoning Board of Appeals, find and believe that sufficient hardship exists so as to justify the granting of said variation. NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there is hereby granted a variation of Section 3-7.D.3 and Section 3-7:E-9 to permit the construction of a seven (7) foot high chain-link fence to be located as set forth above on property located at 1300 Lunt Avenue, Elk Grove Village. Section 2: That the owner shall abide by all of the comments and concerns as set forth in the findings and recommendation of the Chairman of the Zoning Board of Appeals dated December 11, 2003: a. All sections of the fence shall be constructed of black chain link fencing materials. b. No portion of the fence shall extend beyond the 25 -foot front building setback line, or beyond the existing shrubbery located between the entrance to the parking lot and the west lot line. c. The sections of fencing that are adjacent to the front four truck parking spaces along the west side of the parking lot, and the sections of fencing between the west lot line and the entrance to the parking lot shall be provided with black plastic slats to screen the trailers from public view. The petitioner fully agreed to the conditions listed above. Section 3: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
