AN ORDINANCE AMENDING SECTIONS 6-2-2 OF CHAPTER 2 VEHICLE
LICENSES OF THE VILLAGE CODE BY ESTABLISHING PENALTIES FOR
INDIVIDUALS PURCHASING THEIR VEHICLE LICENSE AFTER THE DUE DATE
Section 1: That Section 6-2-2C of the Village Code be amended to read as
follows:
C. Reduced Rates for Certain Persons:
Notwithstanding the provisions of this Chapter, the Vehicle License Fee
for a vehicle registered to a handicapped individual, disabled veteran,
and individuals 65 years of age and over shall be $.50 per year provided
that said individuals purchase their license no later than July 1St of each
year. Any of such individuals purchasing their vehicle license after July 1st
of each year shall pay the fee established in Section 6-2-2A, but not be
subject to further penalty. This reduced rate is for non-commercial
vehicles and excludes trucks having a gross weight of more than 8,000
lbs. and vehicles with dealer plates. Any individual requesting such a
reduced rate shall provide such evidence as is requested by the Finance
Department evidencing ownership of the licensed vehicle, handicapped
status, disabled veteran's status, and/or age. There shall be a maximum
limit of two (2) reduced rate licenses issued to any one household. For
households with multiple vehicles, the reduced rate shall be applied to the
vehicles with the lowest license fee. Qualified individuals who move into
the Village after July 1St of each year or who have acquired a new vehicle
after July 1St of each year shall be entitled to the reduced fee of $.50
provided they purchase their vehicle license within thirty (30) days of their
move in date or their acquisition date whichever is applicable.
Section 2: That Section 6-2-2D Payment of License Fee; Term be amended to
read as follows:
D. Payment of License Fee:
Term:
1. The license fee shall be due and payable annually, by June 1st
of each year, and the license shall be for a one (1) year period.
The fee for a vehicle license purchased after July 1St of each
year shall be the established fee set forth in Paragraph 6-2-2A
plus a late payment fee of an additional 50% of said established
fee.
2. Prorated Fee: Any person who purchases a vehicle or who
becomes a resident of the Village during the last six (6) months
during a licensing year or submits a swom affidavit, properly
notarized, stating that the vehicle for which the license is being
sought was not in use for the first six (6) months of any licensing
year and can substantiate said affidavit to the satisfaction of the
Finance Department, may, upon making application, be issued
a license for the remainder of the licensed period upon payment
of one-half of the fee as established in Section 6-2-2A.
3. Non Payment of Prior Year Vehicle License: Every owner or
operator of a motor vehicle who is required to purchase a vehicle
license pursuant to Section 6-2-2 shall be required to purchase said
vehicle license every year in which the vehicle meets the requirements
of Section 6-6-2. Any person, firm or corporation who has failed to
purchase a vehicle license in any one or more preceding years prior to
the purchase of the current vehicle license, shall be required to pay all
prior delinquencies, plus penalty if applicable, before being eligible to
purchase the current year's license. Evidence that the vehicle was
exempt or otherwise not required to purchase a vehicle license for any
such prior year maybe presented to the Finance Department and the
Finance Department, if satisfied that the evidence justifies an
exemption, may waive the prior year(s) fee requirement.
Section 3: That the Village Clerk is hereby authorized to publish this Ordinance
in pamphlet form.
Section 4: That any person, firm or corporation violating any of the provisions of
this Ordinance shall be subject to a penalty of not less than $25.00 nor more than
$2, 500.00 for each offense and a separate offense shall be deemed committed
for each day during or on which a violation occurs or continues to exist.
Section 5: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form according to law.
