HomeMy WebLinkAboutORDINANCE - 2251 - 6/23/1992 - ANNEXATION/SCHNELL II OAKTON STREETORDINANCE NO. 2251 AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (SCHNELL II - OAKTON STREET) WHEREAS, a written petition has been filed with the Village Clerk of the Village of Elk Grove Village by Ralph, Eleanor, Linda and Lana Schnell, being all legal owners and electors which reside on the property, said petition seeking annexation to the Village of Elk Grove Village of certain land and territory legally described hereinafter; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village; and WHEREAS, the proposed zoning of the property to be annexed is consistent with the zoning attached to said property by the Village's Comprehensive Plan and Official Map; and WHEREAS, any Fire Protection District, Library District, Township Road Commissioner, County Clerk or other entity or person entitled to notice prior to the annexation of the subject property has been given such notice as is required by law; and WHEREAS, the President and Board of Trustees find and believe it to be in the best interest of the Village that said land and territory be annexed to the Village according to the conditions and provisions of the Ordinance. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the land and territory consisting of 1.756 acres, legally described on Exhibit A, attached hereto and by this reference incorporated herein, which land and territory is contiguous to the Village of Elk Grove Village, and not within the limits of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boundary limits of said Village as is by law in such case made and provided. Section 2: That the Village hereby grants I-1 Industrial Zoning to the property being annexed herein, said I-1 Zoning classification being the use set forth for the property on the Village's Official Map. Section 3: That the annexation of the property is subject to the following conditions: a. Annexation fees of $500.00 per acre shall be paid upon annexation of the property to the Village of Elk Grove Village, which funds shall be placed in the Municipal Purpose Fund of the Village. b. Upon annexation, owner shall pay the Village of Elk Grove Village the sum of $766.32 in watermain recapture fees assessed on owner's property as specified in Ordinance No. 1767. c. A Final Plat of Subdivision shall be approved by the Village prior to the issuance of any Building or Engineering Permits. d. Upon annexation, owner shall have four (4) months to demolish existing structures on the property. If not performed within the four (4) month period the annexation is null and void with all fees previously paid to be retained by the Village. e. Upon annexation, owner shall have four (4) months to seal and cap any wells and remove sanitary septic tanks in accordance with applicable Village Ordinance and State Statutes. If not performed within the four (4) month period the annexation is null and void with all fees previously paid to be retained by the Village. Section 4: That the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this Ordinance together with a Plat of Annexation of said territory with the Recorder of Deeds of Cook County, Illinois. Section 5: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. - 2 - Section 6: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
