HomeMy WebLinkAboutORDINANCE - 2263 - 9/8/1992 - BOULDERS IN VILLAGE OWNED PARKWAYSORDINANCE N0. 2263 AN ORDINANCE AMENDING TITLE 8, CHAPTER 8, SECTION 8-8-7B OF THE VILLAGE CODE ALLOWING THE PLACEMENT OF BOULDERS IN VILLAGE OWNED PARKWAYS FOR LAWN PROTECTION PURPOSES WHEREAS, extensive damage has occurred in Village owned parkways occasioned by driver negligence; and WHEREAS, the continual repair of said parkways is an economic burden and hardship on the Village of Elk Grove Village; and WHEREAS, the reasonable placement of boulders in parkways will serve to deter damage to said parkways. NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1. That Section 8-8-7B of Title 8, Chapter 8 of the Village Code be amended to read as follows: It shall be unlawful for any person, firm, or corporation to cause, create, or maintain any obstruction of any pavement, parkway, sidewalk, or other public way or place an obstacle thereon except as may be specifically authorized by ordinance or the Director of Engineering and Community Development. Non -jagged rocks or boulders less then 24 inch by 24 inch in size, standing no higher then 24 inches above the surrounding ground elevation and at least 24 inches behind the back of the curb or roadway shoulder for lawn protection purposes shall be considered authorized under this section of the Village Code. Section 2. That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE: AYE: 6 PASSED this 8th APPROVED this 8th ATTEST: NAY: 0 Patricia S.
