' 2268 AN ORDINANCE GRANTING A VARIATION OF SECTION 3.54 A AND 5.1 OF THE ZONING ORDINANCE TO PERMIT THE RECONSTRUCTION OF AN EXISTING DECK IN A PORTION OF THE REQUIRED REAR YARD ON PROPERTY LOCATED AT 1379 BERKENSHIRE LANE, ELK GROVE VILLAGE (HENRICKS) WHEREAS, the Zoning Board of Appeals at a public meeting duly called and held according to law considered the question of granting a variation of Section 3.54A and Section 5.1 of the Zoning Ordinance to permit the reconstruction of an existing deck which encroaches approximately fifteen feet, four inches (15'4") into the required twenty foot (20') rear yard area on property located at 1379 Berkenshire Lane and legally described hereinafter; and WHEREAS, the President and Board of Trustees after having reviewed the findings and recommendation of said Zoning Board of Appeals find and believe that sufficient hardship exists so as to justify the granting of said variation; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Sections 3.54A and 5.1 of the Zoning Ordinance as they pertain to structures within the required rear yard to permit the reconstruction of an existing deck which encroaches fifteen feet, four inches (15'4") into the required twenty foot (20') rear yard on property located at 1379 Berkenshire Lane and legally described as follows: Lot 4377 in Elk Grove Village Section 14, being a subdivision in the South Z of Section 32, Township 41 North, Range 11, East of the Third Principal Meri- dian, in Cook County, Illinois. Section 2: That this Ordinance shall be in full force and effect from and after its passage approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 13th day of October 1992.
