HomeMy WebLinkAboutORDINANCE - 2205 - 12/10/1991 - SPECIAL USE & VARIATION/1000 DEVONORDINANCE NO. 2205 AN ORDINANCE GRANTING A VARIATION AND A SPECIAL USE PERMIT TO AMERITECH MOBILE COMMUNICATIONS, INC. AND EXEL INN OF CHICAGO TO PERMIT THE CONSTRUCTION OF A CELLULAR TELEPHONE FACILITY TO BE HOUSED WITHIN A SIXTY-FIVE (65') FOOT HIGH FREE STANDING IDENTIFICATION SIGN ON PROPERTY LOCATED AT 1000 DEVON AVENUE, ELK GROVE VILLAGE WHEREAS, the Zoning Board of Appeals of the Village of Elk Grove Village at a public meeting duly called and held according to law considered the question of granting a variation of Section 5.1 of the Zoning Ordinance to permit a structure greater than thirty-five (351) feet in height in a B-2 Zoned District, which structure would consist of a sixty-five (65') foot high identifi- cation sign housing a cellular telephone facility, on property located at 1000 Devon Avenue, Elk Grove Village and legally des- cribed hereinafter; and WHEREAS, the Plan Commission of the Village of Elk Grove Village at a public meeting duly called and held considered the question of granting a Special Use Permit to permit the cellular telephone antenna facility in a B-2 Zoned District on property located at 1000 Devon Avenue, Elk Grove Village; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village after having reviewed the findings of said Zoning Board of Appeals and Plan Commission find and believe it to be in the best interest of the Village that said Special Use Permit and variation be granted. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a Special Use Permit to Exel Inn of Chicago and Ameritech Mobile Communications, Inc. to permit a cellular telephone antenna facility to be housed within a sixty-five (65') foot high, free standing sign on property lo- cated at 1000 Devon Avenue, Elk Grove Village and legally described as follows: Lot 1 in Exel/Wendy's Resubdivision of Lot 9 in Rchlwing Grove, Unit No. 4, being a subdivision of part of the South � of Section 31, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. That the Special Use Permit granted herein is subject to the following conditions: A. If Ameritech Mobile Communications, Inc. removes the cellular telephone antenna facility from the free standing sign, then and in that event Exel Inn shall restore the sign to its present sixty (60') foot height. B. Prior to the construction and placement of any accessory structures, including any electrical transformers or the like, Ameritech will submit a screening plan to the Plan Commission relating to said construction. Ameritech shall landscape the area in accordance with the screening plan approved by said Plan Commission. -2- Section 2: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
