AN ORDINANCE AMENDING ARTICLE 2 GENERAL
REGULATIONS AND PROVISIONS OF CHAPTER 18 LICENSES
AND PERMITS IN ORDER TO PROVIDE A $50.00 SERVICE FEE FOR
CERTAIN LICENSING AND REINSPECTIONS CONDUCTED BY THE HEALTH
DEPARTMENT OF THE VILLAGE
WHEREAS, the Health Department of the Village of Elk Grove
Village is responsible for inspecting premises and vehicles con-
cerning food service, delivery, serving and processing as well
as licenses for day care and health care facilities; and
WHEREAS, the Health Department has advised the President
and Board of Trustees that frequent reinspections are required
due to the Licensees failure to readily comply with applicable
Village Ordinances and Regulations; and
WHEREAS, the number of reinspections requires an unnecessary
utilization of manpower and effort by Health Department employees
which the cost thereof, at present, is not being assessed to the
parties responsible for such additional expense.
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage, Illinois as follows:
Section 1: That Article 2 General Regulations and Provisions
of Chapter 18 Licenses and Permits being the same as hereby amended
by adding thereto a new section which shall read as follows:
18.218 - Inspections of Specific Businesses/Reinspection
Service Fee. The Health Department shall be responsible
for initial inspections and any required reinspections of
food vending vehicles, automatic food/beverage vending machines,
food dealers, food processors, restaurants, food caterers,
day care centers, nursing homes, food delivery vehicles,
day care homes and concregate housing facilities for the
elderly. The purpose of these inspections is to determine
elegibility for the issuance of a business license or any
renewal thereof and for determining continuing compliance
with applicable Village licensing regulations and codes during
the license year. To that end, when the Health Department
determines, after an initial inspection, that additional
reinspection(s) are required due to non-compliance, one initial
reinspection will be made without charge. Thereafter, the
permittee/licensee will be assessed a non-compliance service
fee of $50.00 for each subsequent reinspection during any
such inspection period. Payments must be made in full prior
to the license or any renewal thereof being issued or within
thirty (30) days from the invoice date for inspections occurr-
ing during the license year. Failure to make full payment
as required will serve as grounds to deny the issuance of
such license or permit, or any renewal thereof, or result
in the suspension or revocation of any license or permit
in effect at the time payment is required. Nothing herein

shall be deemed a waiver on the part of the Village from
proceeding with suspending or revoking any business license
as a result of repeated violations or failures to comply
with applicable Village codes and regulations.
Section 2: That in addition to the penalties and/or fees
provided in this Ordinance any person, firm or corporation violating
any of the provisions of this Ordinance shall be subject to a
fine of not less than $25.00 nor more than $500.00 for each offense
and a separate offense shall be deemed commited on each day during
or on which a violation occurs or continues to exist.
Section 3: That the Village Clerk is authorized to publish
this Ordinance in pamphlet form.
Section 4: That this Ordinance shall be in full force and
effect from and after its passage of approval and publication
according to law.
