SCHMIDT Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on January 12, 2021, this Executive Session was called to consider review of Land Acquisition. Number of pages attached: 1 Date(s) of review for release: February 2021 Date of approval for release: Date approved by Village Board: January 26, 2021 January 12, 2021 6:14 pm The Village Attorney provided an update on the eminent domain process for the out lot adjacent to the former Elk Grove Hotel. The Village has filed a preemptive motion which would block the owner from challenging the TIF District where the property is located. The motion is scheduled for January 29, 2021. The Village Attorney is working with the Village's legal team to consider increasing the offer on the land if necessary to reach an agreement outside of the eminent domain process. Eminent domain is a slow process, and it costs money to continue the legal proceedings. The Village has engaged attorneys who specialize in the area, as well as relocation efforts, in order to move the process forward as quickly as possible. The next court hearing is February 8. Prior to pursuing eminent domain, the Village offered to purchase the land for $1.5 million. The Village's initial land appraisal of $1,050,000 did not take into account the value of the businesses, and the appraisal, as well as the Village's formal offer, was revised to $1,300,000. An increased offer could provide an incentive for the opposing attorney to encourage a real estate sale outside of eminent domain. The meeting was adjourned at 6:18 pm.
