Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting
of the Village President and Board of Trustees on January 12, 2021, this Executive Session was
called to consider review of Litigation.

After repeated attempts to move forward with a revised redevelopment agreement for the hotel in
the Technology Park, no reasonable terms could be agreed to between the Village and the
developer. It is possible the Village Board will get additional communications asking for relief --
the developer is trying to go around staff, who have been working at the direction of the Board.
Mayor Johnson has sent a letter to Bhavik Dani reiterating the Village's decision on this point.
The Village may still seek to acquire the property in the TIF District.
The meeting was adjourned at 6:27 pm.
