AN ORDINANCE ADOPTING NEW LICENSING REGULATIONS FOR
PUBLIC PASSENGER VEHICLES AND LIVERY VEHICLES
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village, in their capacity as Public Vehicle Commis-
sion, became increasingly aware of changes in the operation of
licensed taxicab and licensed liveries in the Village of Elk Grove
Village; and
WHEREAS, a determination was made by said Board that it is
in the best interest of the Village to amend the current licensing
provisions for taxicabs and liveries and replace same with a more
regionally orientated public passenger vehicle regulation system;
and
WHEREAS, the Village of Elk Grove Village is a home rule muni-
cipality as defined and established by the Constitution of the
State of Illinois.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage, Illinois as follows:
Section 1: That Article XXXIII Liveries, and Article XLII
Taxicabs of Chapter 42 of the Municipal Code are hereby repealed
and that a new Article XLII is hereby established, which Article
shall read as set forth in Exhibit A attached hereto and by this
referenced incorporated herein.
Section 2: That the Village Clerk is hereby authorized to
publish this Ordinance in pamphlet form.
Section 3: That this Ordinance shall be in full force and
effect from and after July 1, 1992 and license fees for 1992 shall
be pro -rated accordingly.

ARTICLE XLII - PUBLIC PASSENGER VEHICLES
18.4201 Intent and Purpose.) This Article is adopted for the
following purposes:
A. To encourage the best possible public passenger vehicle
service under a competitive system with regulation only
to the extent necessary to protect the safety and wel-
fare of the citizens.
B. To adopt a system of regulation which takes into account
and consideration the present day method and operation
of public passenger vehicle service in the area including
the use of owner operated vehicles, agency agreements
and other contractual relationships between owners and
drivers of public passenger vehicles and companies with
dispatching facilities.
C. To assure that public passenger vehicles are clean, com-
fortable and safe and are operated in accordance with
reasonable standards and regulations for the protection
of all passengers.
D. To provide flexibility in the number of public passenger
vehicles eligible to service the Village of Elk Grove
Village provided same comply with the safety standards
established herein.
E. To ensure that prospective passengers receive timely
response time by the regulation, control and licensing.
of dispatching services.
F. To accomplish the above purposes by multiple licensing
of public passenger vehicle dispatching companies, owners
and drivers of all public passenger vehicles in the Vil-
lage of Elk Grove Village.
18.4202 Definitions.)
A. PUBLIC PASSENGER VEHICLE - Taxicabs and livery vehicles
used for transportation of passengers for hire.
B. DISPATCHER - A person, firm or corporation licensed to
dispatch taxicab or livery service within the Village
and control the inter -relationship of owner operated pub-
lic passenger vehicles or leased public passenger vehi-
cles which have a contractual relationship with their
dispatching service company.
C. INSPECTION STATION - Official State of Illinois testing
station or such other facility designated by the Chief
of Police to conduct inspections required by this Article.
D. TAXICAB - Any public passenger vehicle equipped with
a taxi meter and licensed as a taxicab for the carriage
of passengers for hire to or from destinations as di-
rected by such passenger.
E. LIVERY VEHICLE - Any public passenger vehicle trans-
porting passengers for hire on a pre -arranged contract,
trip or hourly basis.
F. PUBLIC PASSENGER VEHICLE OWNER - Any person owning a
public passenger vehicle for hire.
G. PUBLIC PASSENGER VEHICLE DRIVER - Any person who drives
a public passenger vehicle in use for the transportation
of passengers for compensation.
H. TAXI METER - Any mechanical or electronic device attached
to a taxicab which records and indicates a charge or fare
in dollars and cents measured by distance and waiting time.
I. PUBLIC PASSENGER VEHICLE DISPATCHER'S LICENSE - A license
issued to any person, firm or corporation who operates
a public passenger vehicle dispatching service under a
designated name and which dispatches public passenger
vehicles for transportation purposes, which public pas-
senger vehicles are owned by the dispatching company, or
by third parties who have contractual or agency agree-
ments with the dispatching company.
J. PUBLIC VEHICLE COMMISSION - The President and Board of
Trustees of the Village of Elk Grove Village.
K. TAXICAB LICENSE - A license issued to the owner of a
taxicab eligible to perform transportation services in
the Village.
L. LIVERY LICENSE - A license issued to the owner of a livery
eligible to perform transportation services in the Village.
M. LICENSE YEAR - January 1st through December 31st, of each
year.
N. AGENCY AGREEMENT - A contract or agreement between a
dispatching company and an owner of a public passenger
vehicle relating to the use of a public passenger vehicle
in a licensed service area and dispatching services there-
for.
0. RECIPROCAL LICENSING LIST - A list prepared by the Chief
of Police or his designated agent setting forth the names
of municipalities who license and/or inspect public pas-

senger vehicles which licensing and inspection process
is deemed acceptable to the Village therefor permitting
the holder of such license or inspection certificate to
be licensed or certified within the Village without the
need for extensive or duplicate investigations or inspec-
tions.
18.4203 Public Passenger Vehicle Dispatcher License.)
A. LICENSE REQUIRED. It shall be unlawful for any person,
firm or corporation to dispatch or operate a public pas-
senger vehicle dispatching service within the Village
without first having obtained a Public Passenger Vehicle
Dispatcher License, which License shall be granted in
accordance with the following:
1. The applicant must submit an application, accom-
panied by a non-refundable fee as determined by
the Village containing such information as is gen-
erally required by the Village for all business
licenses and in addition, shall be accompanied by
a letter providing all of the following additional
information, as applicable, if not on the standard
application form:
a. The name, age and address of the applicant
in the case of an individual; in the case of
a co -partnership, the persons entitled to share
in the profits thereof; and in the case of a
corporation, the names and addresses of the
officers and directors, and if a majority in-
terest of the stock of such corporation is
owned by one person or his nominee, the name
and address of such person.
b. Current occupation/employment, business ad-
dress and telephone number.
C. Previous employment history, as required.
d. Any previous convictions of felony and/or traf-
fic violations.
e. The number of vehicles to be operated or con-
trolled by the applicant and the location of
proposed depots, terminals or standing areas.
f. The color scheme or insignia to be used to
designate the vehicle or vehicles of the appli-
cant not in conflict with emergency vehicles
or existing public passenger vehicles.

q. Such other information as may be required by
the Chief of Police or his designated agent.
B. INSURANCE. Applicants for a license or renewal of a
license to operate a public passenger vehicle dispatcher
business in the Village shall produce a copy or copies
of an insurance policy, or certificates of insurance,
with public liability insurance coverage available for
personal injuries in an amount not less than $100,000.00
for each person and $300,000.00 for each accident and
coverage for property damage in an amount not less than
$50,000.00 for each accident for each public passenger
vehicle owned by the dispatching company or any public
passenger vehicle owned by a third person which has an
agency agreement or contractual relationship for dis-
patching services with the applicant.
C. COMPLIANCE AFFIDAVIT. Each applicant must submit an
affidavit to the Village to the effect that the appli-
cant has read and understands the provisions of this
Article and is and at all times will be in compliance
with all of the regulations and conditions herein set
forth.
D. CERTIFICATE OF AUTHORITY. The Public Vehicle Commission,
pursuant to a public hearing, shall authorize one or
more Certificates of Authority to qualified public pas-
senger vehicle dispatcher companies. The selection of
company or companies receiving the Certificates of Autho-
rity shall be based on all evidence presented at the pub-
lic hearing and shall be in the sole discretion of the
Public Vehicle Commission. Once issued, the Certificate
of Authority shall automatically be annually renewed and
remain in existance until such time as revoked or sus-
pended by action of the Public Vehicle Commission.
The Certificate of Authority shall permit the licensee
to provide dispatching services for individually licensed
public passenger vehicles. The number of public passen-
ger vehicle licenses under the control of the dispatching
licensee shall be the number requested by the dispatching
company subject to compliance with the requirements for
such license, there being no limitation as to the number
of licenses or public passenger vehicles permitted under
the control of the licensed dispatcher. The Certificate
of Authority may include public passenger vehicles which
are principally licensed in another municipality listed
on the Village's Reciprocal Licensing List provided that
said public passenger vehicles provide such documentation
as is deemed necessary by the Chief of Police or his de-

signated agent to substantiate the existance of a valid
license and compliance with other provisions of this
Article. The Public Vehicle Commission retains the right
to modify or terminate, the Certificate of Authority for
continued violations of the regulations set forth in
this Article or for such other cause which the Public
Vehicle Commission deems sufficient to terminate or mo-
dify the Certificate of Authority.
REGULATIONS. The public passenger vehicle dispatcher
licensee shall operate its dispatching business in accor-
dance with the following regulations:
1. Each dispatching licensee shall own or have a
binding agency or contractual relationship with
third party owners of public passenger vehicles
in such a nature so as to enable the dispatcher
licensee to have full control and authority over
all of the public passenger vehicles for which it
provides dispatching services.
2. Every person, firm or corporation holding a dis-
patcher license pursuant to a Certificate of Au-
thority shall render an overall service to the pub-
lic desiring to use public passenger vehicles. A
central place of business shall be maintained and
shall be kept open twenty-four hours a day for the
purpose of receiving calls and dispatching public
passenger vehicles. They shall answer all calls
received by them for service inside the corporate
limits of Elk Grove Village as soon as service can
be rendered, but in no event less than thirty minutes
from the time the call for service is made unless a
later time or date is requested. Any dispatcher
licensee who refuses to accept a call or permits
any licensed public passenger vehicle operator or
driver under its control to refuse a call shall be
deemed a violator of this Article and the Certifi-
cate of Authority granted to such licensee shall
be subject to revocation or other penalties in ac-
cordance with the provisions of this Article.
3. The dispatcher licensee shall at all times have
in full force and effect a valid list of licensed
public passenger vehicles under its control, which
list shall indicate the following:
a. The name and address of the owner of each li-
censed public passenger vehicle.
b. The number which the dispatcher licensee has
assigned to each such public passenger vehicle,
which number shall be prominently placed upon
said public passenger vehicle.

C. The name of the Village wherein the public
passenger vehicle is primarily licensed and
in the case of Villages other than Elk Grove
the expiration of the existing licensing and
the expiration date of its Certificate of In-
spection.
4. Each dispatcher licensee shall maintain a register
or log depicting the origin and destination loca-
tions, the date, and the time of each passenger
trip, which register shall be maintained in the
office of the licensee for a minimum of ninety (90)
days from the date of service.
5. Only public passenger vehicles licensed in Elk Grove
Village may be dispatched by a licensed dispatcher
for service originating in Elk Grove Village.
18.4204 Taxicab License.)
A. LICENSE REQUIRED. It shall be unlawful for any person,
firm or corporation to own, operate or lease a taxicab
for hire within the corporate limits of the Village with-
out first having obtained a license in accordance with
the provisions of this Section.
B. APPLICATION. Applications for taxicab licenses shall
be made by the owner upon forms furnished by the Village.
Such application shall contain the full name and address
of the owner of the vehicle; a complete description of
the vehicle, including make, model and vehicle identifi-
cation number; the name of the Elk Grove Village licensed
dispatcher which the owner has a contract or other ar-
rangement for dispatching services; the names of the
operators of said vehicle if other than the owner; in-
formation as to whether the vehicle is licensed in another
town and such supporting information with respect to that
license which may be requested and such other data and
information as the Village may require to assure compli-
ance with requirements of this Article.
C. DISPATCHER AFFILIATION. No license shall issue to any
taxicab without a contractual or other binding arrange-
ment or contract with an Elk Grove Village licensed dis-
patcher. The agreement must identify the taxicab as
one under the control and operation of the licensed dis-
patcher and acknowledge the joint and several obligations
imposed upon the taxicab owner and the licensed dispatcher
as set forth in this Article.
D. INSURANCE. It shall be the responsibility of the owner
to insure that each licensed taxicab has a policy of in-
surance or Certificate of Insurance indicating coverage for

personal injury in an amount of not less than $100,000.00
per person/$300,000.00 per accident and not less than
$50,000.00 for property damage in full force and effect
during the licensing period or a portion thereof subject
to notification of renewal. In the event that such policy
or Certificate of Insurance becomes ineffective or expires
or in the event a licensee has failed to deposit a cur-
rently valid Certificate or policy of insurance, the li-
cense herein provided for the operation of the taxicab
shall automatically terminate without further notice.
E. LISTING OF DRIVERS/PERMIT. It shall be the responsi-
bility of the owner of the licensed taxicab to submit a
list of the names and addresses of all drivers who will
operate the licensed taxicab. All drivers listed must
have a chauffeur or drivers permit issued by the Village.
The owner of the licensed taxicab shall be responsible
for each driver being properly permitted and each driver
complying with the regulations and conditions of this
Article.
F. IDENTIFICATION. Each taxicab licensed hereunder shall
have on each side, in letters identifiable from a mini-
mum distance of twenty (20) feet, the name of the li-
censed dispatcher which the taxicab is associated with;
the telephone number of said company and the number which
the licensed dispatcher has assigned to the taxicab. Each
taxicab must further display an emblem or certificate
issued by the Village of Elk Grove as an indication of
compliance with the licensing provisions of this Section,
said emblem to be located as designated by the Chief of
Police or his designated agent.
G. TAXI METER. Each taxicab shall be equipped with an ap-
proved, accurate and inspected taxi meter to register,
in plain view of the passenger and with proper illumina-
tion, the fare as accumulated while said cab is in opera-
tion. If the taxicab is licensed in another municipality
other than Elk Grove Village, the taxi meter must be cap-
able of registering the proper rate for fares established
by Elk Grove Village. The taxi meter must be inspected
and approved by the Chief of Police or his designated
agent prior to a license being issued. The Chief of Police
or his agent, in their discretion, may but are not re-
quired to, accept the results of prior inspections in
a municipality where testing procedures are deemed ac-
ceptable to the Chief of Police.

H. INSPECTIONS.
1. Inspection Required - The owner of a taxicab must
submit his vehicle for inspection to an authorized
inspection station prior to the issuance of a taxi-
cab license or the renewal thereof and shall also
submit said vehicle for reinspections during the
licensing year. The frequency of reinspections shall
be within the discretion of the Chief of Police pro-
vided that each taxicab will be inspected no less
than two (2) times per year. Upon notification from
the Chief of Police or his designated agent, the
owner of a licensed taxicab shall submit said cab
to an approved inspection station within seven (7)
days from the date of notification.
2. Inspection Stations
a. The inspection station shall be an official
State of Illinois testing station or such other
facility approved and authorized by the Chief
of Police. The inspection station shall com-
ply with established procedures and criteria
for the conducting of inspections and minimum
standards in order that a vehicle be approved,
a copy of said criteria incorporated into the
provisions of this Section by this reference
and copies of which shall be on file in the
Police Department and the inspection stations
authorized by the Chief of Police. The Chief
of Police shall supply inspection stations
with certified inspection forms, certified
vehicle inspection stickers or certificates
and such other supplies as may be required to
perform the duties required by this Section
and the regulations established hereunder.
b. A list of authorized inspection stations shall
be kept by the Chief of Police and shall be
given to each taxicab owner together with the
notice that vehicles must be inspected. An
owner may use the authorized inspection sta-
tion of his choice.
C. Inspection stations shall charge the inspection
fee authorized by the Chief of Police for all
taxicab inspections. There shall be no charge
for a reinspection within five (5) working days
allowed for repairs to a vehicle that fails the
initial inspection. The authorized inspection
fee shall be charged for reinspection made after
the five (5) working day period.

d. The Chief of Police shall cause unannounced
spot checks of authorized inspection stations
to assure compliance with the inspection pro-
cedures, standards and fees, and shall inves-
tigate all complaints or misconduct by inspec-
tion stations or their employees.
e. All inspections. shall include, but need not
be limited to, the following:
(i) Vehicle, make, year and vehicle identi-
fication number.
(ii) State license number and year.
(iii) Village vehicle license number and year.
(iv) Vehicle color.
(v) Vehicle number.
(vi) Company name.
(vii) Service brakes.
(viii) Emergency brakes.
(ix) Horn.
(x) Rear view mirror.
(xi) windshield wipers and washers.
(xii) Headlights.
(xiii) Tail lights.
(xiv) Stop lights.
(xv) Turn signals.
(xvi) Speedometer.
(xvii) Taximeter.
(xviii) Rates displayed.
(xix) Steering.
(xx) Interior condition.
(xxi) Exterior condition.
(xxii) windows.
(xxiii) Tires.
(xxiv) Current bond sticker.
Any taxicab failing to pass the inspection will
be given a period of five (5) working days to
allow for repairs. The vehicle cannot be used
as a taxicab for hire until repairs have been
completed and it passes reinspection. If the
taxicab does not pass reinspection within the
five (5) working day period, or such longer
period as the Chief of Police, in his discre-
tion, may determine, the taxicab license may
be suspended by direction of the Chief of Police
or his designated agent.
f. In lieu of a certificate from an inspection
station, the Chief of Police or his designated
agent in his discretion may accept a Certifi-
cate of Inspection for a taxicab licensed by
another municipality.

I. Any taxicab licensed hereunder who violates any of the
provisions of this Article shall be subject to having
said license suspended or revoked, or be subject to the
payment of a fine, as hereinafter set forth in Section
18.4210.
18.4205 Miscellaneous Taxicab Regulations.) The following regu-
lations shall apply to the operators of all licensed taxicabs in
the Village. It shall be the responsibility of the owner and/or
operator of the licensed vehicles as well as the licensed dis-
patcher under whose authority the taxicab operates to ensure com-
pliance with the provisions of this Section.
A. IDENTIFICATION. Each taxicab shall be identified with
a licensed dispatcher and all taxicabs operating under
the control of any one licensed dispatcher shall be si-
milarly painted, colored or labeled. No taxicab shall
be painted or labeled similar to a taxicab of another
licensed dispatcher so as to deceive the public.
B. CONDITION OF VEHICLE. In addition to the inspection
requirements heretofore established, each taxicab shall
be safe for operation at all times and shall not be dam-
aged, deteriorated or otherwise be in a condition so as
to render said vehicle unfit for public use.
C. NUMBER OF PASSENGERS. No driver or operator of a taxi-
cab shall carry more than the rated passenger load per
vehicle.
D. ESTABLISHED RATES AND CHARGES. No owner, operator or
licensed dispatcher shall charge, collect, receive or
allow an agent or employee to charge, collect or re-
ceive greater rates of compensation than those rates
established in this Section. Rates for taxicab service
shall not exceed the following:
1. Two dollars and forty -cents ($2.40) for the first
mile or fraction thereof.
2. Twenty ($.20) cents for each succeeding one-seventh
of a mile or fraction thereof.
3. Fifty ($.50) cents for each additional passenger
carried on a trip.
4. Eighteen dollars ($18.00) for each sixty (60) mi-
nutes of waiting time calculated at ten ($.10) cents
per twenty (20) seconds.

5. Twenty-five ($.25) cents for each parcel delivered
other than normal luggage.
6. A surcharge of 20% or 50% of the above fares may
be charged for extended trips to designated zones,
which list of zones and the applicable surcharge
shall be approved by the Public Vehicle Commission.
The list shall be on file in the office of the Chief
of Police and in each licensed taxicab and available
for inspection upon request of the passenger.
7. Fixed rates for trips to O'Hare and Midway Airports
shall be as set by the licensed dispatcher with
the approval of the Public Vehicle Commission.
E. POSTING ESTABLISHED RATES AND CHARGES. There shall be
affixed on the inside of each taxicab in a conspicuous
place and in such manner that the same may be easily
and conveniently read by any person riding in such taxi-
cab, a card in a frame covered by glass or other trans-
parent material setting forth the rates of fare as pre-
scribed by the preceding Section.
F. INSPECTION OF TAXI METERS. The Chief of Police or his
designated agent shall make periodic inspections of all
taxi meters to ensure adherence and compliance with es-
tablished rates. Inspection certificates from other
municipalities may but need not be accepted by the Chief
of Police or his designated agent as satisfactory com-
pliance with the provisions of this Section.
G. DEMAND FOR SERVICE. All licensed dispatchers shall be
responsible for each taxicab operating under its control
to regularly and daily operate licensed taxicabs in the
Village to the extent reasonably necessary to meet the
public demand for such taxicab service, including a
twenty-four hour telephone service. Reasonable service
shall be further interpreted to require a thirty minute
maximum response time for each call for taxicab service.
H. PASSENGER SERVICE. It shall be the duty of the driver
of any taxicab to accept as a passenger any person who
seeks taxicab service provided such person is not intoxi-
cated and conducts himself in an orderly manner. No
person shall be admitted to a taxicab already occupied
by a passenger without the consent of said passenger.
The driver shall transport his passenger to the point
of destination by the most direct available route from
the point of origin.

I. RECEIPTS. -n request, any person pay` g a fare shall
be entitle(_ o a receipt indicating ti.- amount paid.
J. CONDUCT OF DRIVER. It shall be unlawful for any driver
or operator of a taxicab, while on duty, to be under the
influence of alcohol or drugs or to use any profane or
obscene language to or in the presence of any passenger.
K. TAXICAB STANDS. Elk Grove Village licensed taxicabs
without passengers and waiting for a dispatched assign-
ment must do so at an authorized taxi stand or such other
waiting area as approved by the Chief of Police or his
designated agent.
L. SENIOR CITIZEN/HANDICAPPED PERSONS PROGRAM. Every taxi-
cab must provide service to senior citizens in accordance
with the Elk Grove Village Senior Citizen/Handicapped
Persons Subsidized Taxicab Program.
M. EXCLUSIVE PERMISSION GRANTED/INTER-URBAN OPERATIONS.
Subject to the conditions and limitations of this Article,
exclusive permission and authority are hereby granted to
the licensees hereunder to operate a taxicab as licensed
hereunder upon the public streets and other public ways
within the corporate limits of the Village unless sus-
pended or revoked as hereinafter provided.
It shall be unlawful and the Village will not permit any
public passenger vehicle not licensed by the Village to
solicit business within the Village or to accept for
transportation any passengers within the Village, except
such transportation which has been arranged for in ad-
cance by telephone or written order.
Nothing in this Section shall be construed to prohibit
any public passenger vehicle from coming into the Village
to discharge passengers accepted for transporation out-
side the Village. While said vehicle is in the Village,
no roof light or other special light shall be used to
indicate that the vehicle is vacant or subject to hire
and a visable card or flag shall be displayed at the wind-
shield of the vehicle bearing the words "Not For Hire".
No person shall be solicited or accepted in said vehicle
for transportation from any place within the Village.
N. ADVERTISING. It shall be unlawful for any taxicab to
advertise or affix signs to said taxicab for the pur-
pose of advertising businesses or commerical uses unre-
lated to said taxicab company.
0. TRANSFER PROHIBITED. It shall be unlawful for any taxi-
cab licensee to transfer or sell the taxicab license to
another person. Transference of such license shall be
grounds for revocation.
P. PROHIBITED MATERIAL CONVEYANCE. It shall be unlawful
for any taxicab which conveys passengers to convey toxic,
hazardous or biological waste material at any time.

18.4206 Livery License.)
A. LICENSE REQUIRED. It shall be unlawful for any person,
firm or corporation to conduct, engage in, maintain,
operate, a livery vehicle either by himself or through
an agent., employee or partner, without first having ob-
tained a livery license as herein provided. Any livery
licensed, housed and operated in a municipality other
than Elk Grove Village is exempt from the provisions
of this Section.
B. APPLICATION. An application for a license under this
Article shall be made in conformity with the general
requirements of this Code relating to applications for
licenses. Such application shall specify the number
of vehicles to be used by the licensee in the Village
of Elk Grove and such additional information as the Vil-
lage may require to assure compliance with the require-
ments of this Article.
C. DISPATCHER AFFILIATION. No license shall be issued to
any livery without a contractual or other binding arrange-
ment or contract with an Elk Grove Village licensed dis-
patcher. The agreement must identify the livery as one
under the control and operation of the licensed dispatcher
and acknowledge the joint and several obligations imposed
upon the livery owner and the licensed dispatcher as set
forth in this Article.
D. INSURANCE. It shall be the responsibility of the vehicle
owner to ensure that each licensed livery has a policy of
insurance or Certificate of Insurance indicating cover-
age for personal injury in an amount of not less than
$100,000.00 per person/$300,000.00 per accident and not
less than $50,000.00 for property damage in full force
and effect during the licensing period or a portion there-
of subject to notification of renewal. In the event that
such policy or Certificate of Insurance becomes ineffec-
tive or expires or in the event a licensee had failed to
deposit a currently valid Certificate or policy of insur-
ance, the license herein provided for the operation of
livery shall automatically terminate without further
notice.
E. LISTING OF DRIVERS/PERMIT. It shall be the responsi-
bility of the owner of the licensed livery to submit
a list of the names and addresses of all drivers who
will operate the licensed livery. All drivers listed
must have a chauffeur or driver's permit issued by the
Village. The owner of the licensed livery shall be re-
sponsible for each driver being properly permitted and
each driver complying with the regulations and conditions
of this Article.

F. IDENTIFICATION. Each livery must display an emblem or
certificate issued by the Village of Elk Grove Village
as an indication of compliance with the licensing provi-
sions of this Section, said emblem to be located as de-
signated by the Chief of Police.
G. INSPECTIONS
1. Inspection Required - The owner of a livery must
submit his vehicle to an authorized inspection sta-
tion for inspection prior to the issuance of a li-
very license or the renewal thereof and shall also
submit said vehicle for reinspections during the
licensing year. The frequency of reinspections
shall be within the discretion of the Chief of Po-
lice provided that each livery shall be inspected
no less than two (2) times per year. Upon notifi-
cation from the Chief of Police or his designated
agent, the owner of a licensed livery shall submit
said livery to an approved inspection station with-
in seven (7) days from the date of notification.
2. Inspection Stations
a. The inspection station shall be an official
State of Illinois testing station or such other
facility approved and authorized by the Chief
of Police. The inspection station shall comply
with established procedures and criteria for
the conducting of inspections and minimum stan-
dards in order that a vehicle be approved, a
copy of said criteria incorporated into the
provisions of this Section by this reference
and copies of which shall be on file in the
Police Department and the inspection stations
authorized by the Chief of Police. The Chief
of Police shall supply inspection stations
with certified inspection forms, certified
vehicle inspection stickers or certificates
and such other supplies as may be required
to perform the duties required by this Section
and the regulations established hereunder.
b. A list of authorized inspection stations shall
be kept by the Chief of Police and shall be
given to each livery owner together with the
notice that vehicles must be inspected. An
owner may use the authorized inspection sta-
tion of his choice.

C. Inspection stations shall charge the inspection
fee authorized by the Chief of Police for all
taxicab inspections. There shall be no charge
for a reinspection within five (5) working days
allowed for repairs to a vehicle that fails
the initial inspection. The authorized inspec-
tion fee shall be charged for reinspection made
after the five (5) working day period.
d. The Chief of Police shall cause unannounced
spot checks of authorized inspection stations
to assure compliance with the inspection proce-
dures, standards and fees, and shall investi-
gate all complaints or misconduct by inspection
stations or their employees.
e. All inspections shall include, but need not be
limited to, the following:
(i) Vehicle make, year and vehicle identifi-
cation number.
(ii) State license number and year.
(iii) Village vehicle license number and year.
(iv) vehicle color.
(v) vehicle number.
(vi) Company name.
(vii) Service brakes.
(viii) Emergency brakes.
(ix) Horn.
(x) Rear view mirror.
(xi) windshield wipers and washers.
(xii) Headlights.
(xiii) Tail lights.
(xiv) Stop lights.
(xv) Turn signals.
(xvi) Speedometer.
(xvii) Steering.
(xviii) Interior condition.
(xix) Exterior condition.
(xx) Windows.
(xxi) Tires.
(xxii) Current bond sticker.
Any livery failing to pass the inspection will
be given a period of five (5) working days to
allow for repairs. The vehicle cannot be used
as a livery for hire until repairs have been
completed and it passes reinspection. If the
livery does not pass reinspection within the
five (5) working day period, or such longer
period as the Chief of Police, in his discre-
tion, may determine, the livery license may
be suspended by direction of the Chief of Police,
or his designated agent.

f. In lieu of a certificate from an inspection
station, the Chief of Police or his designated
agent in his discretion may accept a Certifi-
cate of Inspection for a livery licensed by
another municipality.
H. Any livery licensed hereunder who violates any of the
provisions of this Article shall be subject to having
said license suspended or revoked, or be subject to the
payment of a fine, as hereinafter set forth in Section
18.4210.
18.4207 Miscellaneous Livery Regulations.) The following regula-
tions shall apply to the operators of all licensed livery in the
Village. It shall be the responsibility of the owner and/or oper-
ator of the licensed vehicles as well as the licensed dispatcher
under whose authority the livery operates to ensure compliance
with the provisions of this Section.
A. CONDITION OF VEHICLE. In addition to the inspection
requirements heretofore established, each livery shall
be safe for operation at all times and shall not be dam-
aged, deteriorated or otherwise be in a condition so
as to render said vehicle unfit for public use.
B. NUMBER OF PASSENGERS. No driver or operator of a livery
shall carry more than the rated passenger load per vehicle.
C. RECEIPTS. On request, any person paying fare shall be
entitled to a receipt indicating the amount paid.
D. CONDUCT OF DRIVER. It shall be unlawful for any driver
or operator of a livery, while on duty, to be under the
influence of alcohol or drugs or to use any profane or
obscene language to or in the presence of any passenger.
E. ADVERTISING. It shall be unlawful for any livery to
advertise or affix signs to said livery for the purpose
of advertising businesses or commercial uses unrelated
to said livery company.
F. TRANSFER PROHIBITED. It shall be unlawful for any livery
licensee to transfer or sell the livery license to another
person. Transference of such license shall be grounds
for revocation.
G. HOLDING AREAS. Livery vehicles shall not park in taxicab
stands.
H. SCOPE OF OPERATIONS. Livery vehicles shall not pick up
or solicit passengers for hire from the streets but shall
be limited in scope of operation to carrying passengers

for hire on a contract basis at a price agreed upon prior
to employment and by arrangement of the parties at the
time of initial contact by customer to the livery company
I. PROHIBITED MATERIAL CONVEYANCE. It shall be unlawful
for any livery which conveys passengers to convey toxic,
hazardous or biological waste material at any time.
J. VIOLATION OF ORDINANCE. Any licensed livery who violates
any of the provisions of this Article shall be subject to
having said license suspended or revoked, or be subject
to the payment of fine as hereinafter set forth in Section
18.4210.
18.4208 Public Passenger Vehicle Chauffeur's Permit.)
A. LICENSED REQUIRED. It shall be unlawful for any person
to operate a public passenger vehicle within the Village
of Elk Grove Village without first having obtained a
valid chauffeur's permit therefor as herein provided.
B. APPLICATION. Any person desiring to secure a chauffeur's
permit or renewal thereof shall make application in writ-
ing therefor to the Chief of Police or his designated
agent. The application for the permit shall contain the
name of the applicant; his residence and employment his-
tory; driver's license number and current status thereof;
information as to whether the State's driver's license
has ever been suspended or revoked and if so, when and
for what cause; a list of all convictions, if any, for
violation of Federal, State or municipal laws; and such
other information as deemed appropriate by the Chief
of Police.
C. QUALIFICATIONS.
1. Every applicant for a public passenger vehicle chauf-
feur's license shall be no less than twenty-one (21)
years of age.
2. The applicant must be the holder of a valid State of
Illinois Driver's license authorizing the operation
of a vehicle transporting fare paying passengers.
3. The applicant must not have been convicted of any
felony or Class A misdemeanor within the past five
(5) years.
4. The applicant must not have had his driver's license
suspended or revoked in any state within the past
three (3) years as a consequence of violations of
law concerning his operation of a motor vehicle.

D. ISSUANCE/DISPLAY. If the Chief of Police or his desig-
nated agent shall be satisfied that the applicant satis-
fies the requirements set forth in this Section, such
application shall be approved and the permit issued.
The operator's permit shall be displayed at all times
in the public passenger vehicle driven by the operator
in plain view of the passenger. It shall be unlawful
to transfer any operator's permit from one person to
another.
E. REGIONAL RECIPROCITY. The Chief of Police or his desig-
nated agent is authorized to issue a permit to any appli-
cant who has a current valid public passenger vehicle
chauffeur's license or comparable permit issued by another
municipality listed on the Reciprocal Licensing List with-
out requiring the applicant to complete the full applica-
tion process set forth herein. The Chief of Police may
authorize such additional testing as he deems necessary
to ensure the applicant's qualifications under the provi-
sions of this Section.
F. VIOLATIONS. Any permittee hereunder who violates any of
the provisions of this Article shall be subject to having
his permit suspended or revoked, or be subject to the pay-
ment of a fine as hereinafter set forth in Section 18.4210.
18.4209 License and Permit Fees/Term of License.)
A. FEES. The annual license fee for dispatcher, taxicab
and livery licenses and for chauffeur's permits shall
be as follows:
1. Public Passenger Vehicle dispatcher - Two Hundred
($200.00) Dollars.
2. Taxicab license - Fifty ($50.00) Dollars per year.
3. Livery license - Fifty ($50.00) Dollars per year.
4. Chauffeur's permit - Ten ($10.00) Dollars per year.
B. LICENSE TERM. All licenses and permits shall commence on
the 1st day of January and expire on December 31st of each
year.
18.4210 Suspension, Revocation, Fine.) Any licensed dispatcher,
taxicab licensee, livery licensee or chauffeur permittee who vio-
lates the provisions of this Article shall be subject to having
his license or permit suspended or revoked, or having a fine im-
posed by the Public Vehicle Commission. Notice of a violation
shall be sent to the licensee/permittee setting forth the nature
of the violation and the time, date and location of a hearing be-
fore the Public Vehicle Commission concerning said violation. At
such hearing, the Chief of Police or his designated agent shall
provide evidence to the Commission relative to the cited viola-
tion and the licensee/permittee may provide such testimony, evi-
dence or explanation as the licensee/permittee deems necessary.
After hearing the evidence presented, the Public Vehicle Commis-
sion may suspend, revoke and/or fine up to One Thousand ($1,000.00)
Dollars any person, firm or corporation which the Public Vehicle
Commission finds guilty of violating any provision of this Article;
or in the alternative render a finding of not guilty as the case
may be. In cases where the public health, safety and welfare is
jeopardized by such violation, the Chief of Police may temporarily
suspend said license or permit pending a hearing before the Public
Vehicle Commission. In addition, the Chief of Police or his desig-
nated agent is authorized to resolve or abate minor violations
without the need for a hearing and without the imposition of sus-
pension, revocation or fine. Notwithstanding the above, a license
or permit shall automatically be suspended for violations relating
to effective insurance in existance or upon the finding of false
information submitted on any application form. Appeals of auto-
matic suspensions may be made to the Public Vehicle Commission and
shall be held in accordance with the provisions of this Section.
