Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting
of the Village President and Board of Trustees on February 23, 2021, this Executive Session was
called to consider review of Litigation.

There was a court hearing today on the condemnation of the outlot adjacent to the former Elk
Grove Hotel. The Village Attorney reported that the owner of the outlot may be interested in a
settlement to avoid additional costs for the testimony of expert witnesses. The owner's attorney
has shared that they have a strong desire to continue to operate the existing business in the
location for a while, which could assist in the settlement. The Village Attorney requested details
on the duration of the stay requested. It may not be prohibitive to allow the owner to continue to
operate at this site through the end of the year. This could also assist the Village in potential
relocation costs.
Mayor Johnson noted that the data center interested in developing the former Elk Grove Motel
site asked specifically about this out lot.
The Village Attorney also requested the owner consider agreeing to enter into a real estate
agreement separate from the lawsuit, which would remove any use restrictions on the property.
There is a risk to withdrawing the lawsuit, as the property owner has been unreliable with regard
to agreements in the past.
