KNICKERBOCKER Village Attorney Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on February 23, 2021, this Executive Session was called to consider review of Land Disposition. Number of pages attached: 1 Date(s) of review for release: February 2022 Date of approval for release: Date approved by Village Board: March 9, 2021 February 23, 2021 9:23 pm Mayor Johnson asked the Village Attorney for an update on the relocation of the cell tower from the former Oakton Fire Station to Udall Park. The new tower has been constructed, but Sprint remains on the older tower and is moving slowly. The Village Attorney participated on a call with Microsoft and SBA, the tower owner, about why Sprint is taking so long to move. He expects that Sprint will be looking to renegotiate their lease agreement with the Village to reduce their rent while they have the leverage of being able to delay the demolition of the old tower. Microsoft needs the tower to be moved as soon as possible so they can continue with their construction on this site. Microsoft will be giving the Village official 4-month notice to vacate the site of the old cell tower, however Sprint has some protection from the FCC, which may prevent anything that interrupts their coverage. Sprint pays the Village approximately $3,000 a month in rent on the site. The consensus of the Board was that staff should negotiate with Sprint to ensure this issue does not delay the Microsoft development. The Village Attorney advised that it may be necessary for the Village Board to approve a lease amendment resulting in a reduction of rent to hasten Sprint's relocation. The meeting was adjourned at 9:27 pm.
