AN ORDINANCE PROHIBITING ENCROACHMENTS WITHIN THE
STATE OF ILLINOIS RIGHT OF WAY ALONG
ELMHURST ROAD AND ILLINOIS ROUTE 72
WHEREAS, the State of Illinois, acting by and through its Department of
Transportation, is desirous of improving Elmhurst Road and Illinois Route
72 in the Village of Elk Grove Village; and
WHEREAS, said project is being constructed in order to facilitate the
free flow of traffic and ensure safety to the motoring public; and
WHEREAS, a portion of said project passes through the Village of Elk
Grove Village.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois
as follows:
Section 1: That no person, firm, corporation or other entity shall
install, place, maintain or construct any structure that encroaches upon
the State of Illinois right of way on Elmhurst Road and Illinois Route 72
within the limits of the Village of Elk Grove Village.
Section 2: That the Village Clerk of the Village of Elk Grove
Village is hereby authorized and directed to attach a copy of this
Ordinance to the agreement dated June 25, 1991, by and between the State of
Illinois and the Village of Elk Grove Village relative to the improvement
of Elmhurst Road and Illinois Route 72.
Section 3: That this Ordinance shall be in full force and effect
from and after its passage and approval according to law.
