HomeMy WebLinkAboutORDINANCE - 2130 - 10/23/1990 - ANNEXING IDOT MAINTENANCE YARDORDINANCE NO. 2130 AN ORDINANCE ANNEXING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (ILLINOIS DEPARTMENT OF TRANSPORTATION) WHEREAS, a written Petition has been filed with the Village Clerk of the Village of Elk Grove Village by the Department of Transportation of the State of Illinois (hereinafter referred to as "IDOT"); said Petition seeking annexation to the Village of Elk Grove Village of certain land and territory legally described hereinafter; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village; and WHEREAS, any Fire Protection District, Library District, Town- ship Road Commissioner, County Clerk or other entity or person en- titled to notice prior to the annexation of the subject property has been given such notice as is required by law; and WHEREAS, the President and Board of Trustees find and believe it to be in the best interest of the Village that said land and territory be annexed to the Village. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Counties, Illinois as follows: Section 1: That the land and territory legally described on Exhibit A, attached hereto and by this reference incorporated here- in, which land and territory is contiguous to the Village of Elk Grove Village and not within the limits of any other municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within the boun- dary limits of said Village as is by law in such case made and pro- vided. Section 2: That said land and territory, upon annexation, shall be classified under the Village's R-3 Residential Zoned Dis- trict, which classification is as set forth in the Village's offi- cial zoning map and Comprehensive Plan. Section 3: That IDOT shall, upon annexation, pay the sum of $5,216.50 to the Village's Municipal Purpose Fund and a recapture fee of $1,220.66 for water main improvements as established pursu- ant to Ordinance No. 668 and in addition shall be responsible for the water meter and connection charges and the actual cost of pub- lishing the legal notice for the Special Use hearing relating to this annexation. IDOT shall be exempt from and the Village of Elk Grove Village does hereby waive the water and sewer inspection fee, the ten (10%) percent land donation requirement, building and engi- neering fees, the court reporter fee for the Special Use hearing and the annexation application fee. Section 4: That at such time the existing septic field in the maintenance facility is no longer functional, IDOT shall connect to the Village sanitary system. Section 5: That the Village Clerk of the Village of Elk Grove Village is directed to record the certified copy of this Ordinance, together with a Plat of Annexation of said territory with the Re- corder of Deeds of Cook County, Illinois. -2- Section 6: That the Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 7: That this Ordinance shall be in full force and ef- fect from and after its passage, approval and publication and re- ceipt of the requisite consent from the Governor of the State of Illinois, all as in accordance with and required by law. GOVERNOR'S CONSENT TO ANNEXATION WHEREAS, the Department of Transportation has filed a petition for annexation with the Village of Elk Grove Village for property owned by the State of Illinois for the use of the Illinois Department of Transportation; WHEREAS, said property is currently being used by the Department as a maintenance facility and is located at the southeast corner of Biesterfield Road and Interstate 290; WHEREAS, Section 7-1-2 of Chapter 24 of the Illinois Revised Statutes requires written permission of the Governor for annexation of land owned by the State; and WHEREAS, the Village of Elk Grove Village, by Ordinance No. 2130, on October 23, 1990, annexed the Department's property described in Exhibit A attached to said ordinance contingent upon the Governor of the State of Illinois consenting to said annexation; NOW, THEREFORE, as Governor of the State of Illinois, I grant my consent to the annexation of the aforesaid property to the Village of Elk Grove Village, in accordance with the Village ordinance dated October 23, 1990 and the provision of Chapter 24, Section 7-1-2 of the Illinois Revised Statutes.
