HomeMy WebLinkAboutORDINANCE - 2161 - 5/14/1991 - ZONING VARIATION/474 FRANKLINNO. 2161 AN ORDINANCE GRANTING A VARIATION OF SECTION 5.1 OF THE ZONING ORDINANCE AS IT PERTAINS TO REQUIRED REAR YARD SETBACKS TO PERMIT THE CONSTRUCTION OF A SCREENED PATIO ENCLOSURE ON PROPERTY LOCATED AT 474 FRANKLIN LANE, ELK GROVE VILLAGE (DAISH) WHEREAS, the Zoning Board of Appeals at a public meeting duly called and held according to law considered the question of granting a variation of Section 5.1 of the Zoning Ordinance as it pertains to required rear yard setbacks to permit a 3.52' overhang encroach- ment and a 2.52' base encroachment of the rear setback for property located at 474 Franklin Lane and legally described hereinafter; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove after having reviewed the recommendation and findings of said Zoning Board of Appeals find and believe that sufficient hard- ship exists so as to justify the granting of said variation. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 5.1 of the Zoning Ordinance as it pertains to required rear yard set- backs to permit the construction of a screened patio enclosure which would encroach 2.52 feet into the required twenty (201) foot rear yard and a 3.52 foot overhang encroachment on property located at 474 Franklin Lane and legally described as follows: Lot 163 in Winston Grove Section 23A being a Subdivi- sion in parts of Sections 25 and 26, Township 41 North, Range 10, East of the Third Principal Meridian, in Cook County, Illinois. Section 2: That this Ordinance shall be in full force and ef- fect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 14th day of May 1991.
