AN ORDINANCE REZONING CERTAIN PROPERTY LOCATED AT THE
INTERSECTION OF HIGGINS ROAD AND ARLINGTON HEIGHTS ROAD
FROM B-1 SHOPPING CENTER TO B-3 BUSINESS (PARR -N -SHOP)
WHEREAS, the Plan Commission at a public meeting duly called
and held according to law considered the question of rezoning pro-
perty located at the intersection of Arlington Heights Road and
Higgins Road, and legally described hereinafter, from the B-1 Busi-
ness District to the B-3 Business District; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village after having reviewed the recommendation and
finding of said Plan Commission find and believe it to be in the
best interest of the Village that said property be rezoned as re-
quested.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois as follows:
Section 1: That the property located at the intersection of
Arlington Heights Road and Higgins Road, which property is legally
described on Exhibit A attached hereto be and the same is hereby
rezoned from the B-1 Business District to the B-3 Business District
subject to the following conditions:
A. That the owner of the property install sidewalks
along the frontages of Higgins Road and Arlington Heights Road pro-
vided that the installation of the sidewalk along Arlington Heights
Road can be postponed until after Arlington Heights Road is widened
if the owner submits a statement of commitment to construct the
sidewalk along Arlington Heights Road at the appropriate time.
B. That the property be developed in accordance with
the Site Plan previously approved by the Plan Commission, copies
of said Site Plan being on file in the Office of the Village Clerk.
Section 2: That this Ordinance shall be in full force and
effect from and after its passage and approval according to law.

Section 5: Collection of Tax. The taxes hereby imposed, and all civil penalties that may
be assessed as an incident thereto, shall be collected and enforced by the Illinois Department of
Revenue. The Department of Revenue shall have full power to administer and enforce the
provisions of this Ordinance.
Section 6: The Village Clerk is hereby directed to file a certified copy of this Ordinance
on or before the first day of June, 1991.
Section 7: This Ordinance shall be in full force and effect on September 1, 1991 after
its adoption, filing and publication in pamphlet form in the manner provided by law.
