AN ORDINANCE AMENDING ARTICLE I DEVELOPMENT AND BUILDING
DEPARTMENT OF CHAPTER 13 BUILDING ACTIVITY CODES OF
THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE
BE IT ORDAINED by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage,
Illinois as follows:
Section 1: That Article I Development and Building Department
of Chapter 13 of the Municipal Code be and the same is hereby
repealed.
Section 2: That Chapter 13 of the Municipal Code is hereby
amended by establishing a new Article I entitled ENGINEERING
AND COMMUNITY DEVELOPMENT DEPARTMENT, which Article shall read
as follows:
ARTICLE I - ENGINEERING AND COMMUNITY DEVELOPMENT DEPARTMENT
13.101 Creation
There is hereby created a Department of Engineering and
Community Development which shall consist of a Director
of Engineering and Community Development and such other
employees as may be authorized by the President and Board
of Trustees.
13.102
There is hereby established the position of Director of
Engineering and Community Development. The Director of
Engineering and Community Development shall be appointed
by the Village Manager and shall serve at his discretion.
The Director of Engineering and Community Development shall
have control and supervision over all offices and employees
assigned to the Department of Engineering and Community
Development, subject to the general direction of the Village
Manager. Whenever the term Building Official, Building
Commissioner or Village Engineer is used in any portion
of a Municipal Code of the Village or of any other regu-
latory codes adopted by reference by the Village, it shall
mean the Director of Engineering and Community Development.
13.103 Duties of the Director of Engineering and Community
Development
The Director of Engineering and Community Development shall
be responsible for:
A. The enforcement of all ordinances, codes and
regulations of the Village relating to the
construction, repair or alteration of buildings
and structures.
B. The enforcement of all ordinances, codes and
regulations of the Village relating to the
construction, extension or alteration of
public and private utility improvements.
C. All inspections to insure compliance with
building, zoning, land use, subdivision and
municipal code regulations.
D. The maintenance of land use and zoning maps
and plat, utility atlases, as -built construction
drawings and engineering drawings related to
public and private improvements.
E. The preparation of design plans and speci-
fications for the construction of Village
improvement projects.
F. Performing such other duties as may be required
by the Village Manager including providing
assistance and advice to Boards, Commissions and
related agencies of the Village.
13.104 Enforcement Authority
The Director of Engineering and Community Development and
such officers, inspectors and employees within the Depart-
ment as designated by the Director of Engineering and Com-
munity Development are hereby authorized to issue citations,
notices to appear in court or complaints for any violations
of Chapter 8 and Chapter 11 of the Municipal Code and such
other provisions of the Municipal Code or other codes pre-
viously adopted by reference by the Village.
Section 3: That all references within the Municipal Code
to the Building Department or to the Engineering Department shall
be amended and be deemed to refer to the Engineering and Community
Development Department.

Section 4: That Chapter 24A SETTLEMENT OF PENALTIES is
hereby amended by adding thereto a new Article which shall read
as follows:
ARTICLE IV
SETTLEMENT OF PENALTIES BY THE DEPARTMENT
OF ENGINEERING AND COMMUNITY DEVELOPMENT
24A.401 The Department of Engineering and Community De-
velopment of the Village of Elk Grove Village, through its
Director and duly appointed officers, inspectors and em-
ployees are hereby authorized to issue citations, notices
to appear in court or complaints for all the violations
of Chapter 8 and Chapter 11 of the Municipal Code and such
other codes concerning the development of land and building
and engineering regulations within the Village previously
adopted by reference by the Village of Elk Grove Village.
24A.402 Settlement.) Any person, firm or corporation upon
whom a citation or notice is served, whether by personal
service, service by certified mail or otherwise, may elect
to settle and compromise the penalty arising from same by
paying to the Village Clerk at the Village Hall the following
settlement amounts:

24A.403 Due Date - Final Notice Date.) The due date for 1
settlement of any offense cited by the Director of Engi-
neering and Community Development or any officer, inspector
or employee designated by the Director shall be five (5)
days from the date on which the citation or notice is served.
The final notice date shall be five (5) days from the date
on which said final notice is served.
24A.404 Sworn Complaint.) In the event that the person,
firm or corporation upon whom such citation or notice to
appear is issued, fails to settle and compromise said claim
within the prescribed time, then the Director of Engineering
and Community Development or such officer, inspector or
employee designated by such Director is'authorized and
directed to file a sworn complaint in the Circuit Court
of Cook or DuPage County (as jurisdiction directs), charging
the violator with the violations set forth on the citation
above referred to. A copy of such complaint or summons
shall be issued and served upon the defendant violator in
the manner prescribed by law, setting forth the date, time
and place such complaint shall be heard by the Court.

Section 5: That Sections 11.206, 11.314 and 11.409 of the
Municipal Code are hereby amended to read as follows:

11.409 Penalty.) Any person, firm or corporation violating
the provisions of this Article shall be subject to a fine
of not less than Twenty -Five ($25.00) Dollars nor more than
Five Hundred ($500.00) Dollars for each offense and a separate
offense shall be deemed committed on each day during or
on which a violation continues to exist.
In addition to any penalty as hereinabove provided, the
Village of Elk Grove Village shall have the right by injunc-
tion to enjoin the use of such offense in cases of emergency
by proceeding with the complaint therefor in the Third Muni-
cipal District of the Circuit Court of Cook County or such
other Circuit Court of appropriate jurisdiction.
Section 6: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication accor-
ding to law.
