AN ORDINANCE AMENDING ARTICLE XII, DEALERS OF ALCOHOLIC
LIQUOR OF CHAPTER 18 OF THE MUNICIPAL CODE AS IT
CONCERNS HOURS OF OPERATION FOR CLASS A AND CLASS AA LICENSES
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village have become aware of continuing incidents
of arrest and Ordinance and criminal code violations presently
occurring during late hours of operation on premises presently
licensed with a Class A or AA liquor license; and
WHEREAS, the President and Board of Trustees are further
aware of an increase in incidents involving driving while under
the influence of intoxicating liquor; and
WHEREAS, the Village of Elk Grove Village is a Home Rule
Municipality and in said capacity deems it necessary and advisable
to pass and enact legislation pertaining to its governmental
affairs and which promotes the health, safety and welfare of
its residents and residents of surrounding communities and that
it is necessary to reduce the hours in which Class A and Class
AA liquor licenses are open for business.
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois as follows:
Section 1: That Section 18.1204 A. LICENSE TYPES shall
be amended by deleting therefrom the present description of the
Class AA license and inserting therein the following:
Class "AA" LICENSE, which shall authorize the
sale of alcoholic liquor for comsumption only
on the premises for such additional time as
is set forth in Section 18.1205 B. of this
Article XII.
Section 2: That Section 18.1205 B CLOSING HOURS of Chapter
18 of the Municipal Code is hereby amended to read as follows:
B. CLOSING HOURS: It shall be unlawful to sell
alcoholic liquor for consumption off the premises
between the hours of 1:00 a.m. and 6:00 a.m, on
any day except Saturdays, Sundays and January 1st
of each year, and on Saturdays, Sundays and Janu-
ary 1st of each year between 2:00 a.m, and 6:00 a.m.
It shall be unlawful to sell, permit the consump-
tion of, make available for consumption alcoholic
liquor on the premises where the same is sold for
consumption between the hours of 1:00 a.m. and
6:00 a.m. on any day except Saturday, Sunday and
January lst of each year, and on Saturdays, Sun-
days and January 1st of each year between 2:00 a.m.
and 6:00 a.m.
The above provisions shall not apply to the holders
of Class "AA" licenses in which case it shall be
unlawful to sell, permit the consumption of or
make available for consumption alcoholic liquor
on the premises where same is sold for consumption
between the hours of 2:00 a.m. and 6:00 a.m. on
any day except Saturday, Sunday and January 1st
of each year, and on Saturdays, Sundays and Janu-
ary 1st of each year between 3:00 a.m. and 6:00 a.m.
The term "premises" u.,�ed herein shall include in
its meaning any portion thereof as well as the
whole of any buildings or real property under the
same or similar ownership or control. The fore-
going shall not be interpreted so as to prevent
the sale of food or non-alcoholic beverages on
said premises after the hours specified above.
Section 3:
Any person, firm or corporation violating any
of the provisions of this Ordinance shall be subject to a fine
of not less than Twenty -Five ($25.00) Dollars nor more than Five
Hundred ($500.00) Dollars for each offense. In addition to any

such penalty as set forth above any person, firm or corporation
who violates any of the provisions of this Ordinance shall be
subject to such additional sanctions including license suspension
and revocation as is set forth in Section 18.1206 of the Municipal
Code.
Section 4: That the Village Clerk is hereby authorized
to publish this Ordinance in pamphlet form.
Section 5: That this Ordinance shall be in full force and effect
September 1, 1939 and upon its passage, approval and publication according
to law.
