HomeMy WebLinkAboutORDINANCE - 2049 - 6/13/1989 - PLAT OF VACATION/TURNER AVEORDINANCE NO. 2049 AN ORDINANCE APPROVING THE EXECUTION AND RECORDING OF A PLAT OF VACATION OF PUBLIC STREET FOR A PORTION OF TURNER AVENUE P R E A M B L E WHEREAS, the existing public street known as Turner Avenue has previously been dedicated to the Village of Elk Grove Village, and said dedication has been acknowledged by the Village, and was recorded by Document No. 20397381; and WHEREAS, provisions of Sections 11-91-1 and 11-91-2 of Article 11 of the Illinois Municipal Code grant to the corporate authorities of the Village the power to determine that the public interest will be subserved by vacating any street or alley, or part thereof, within their jurisdiction in any incorporated area, by ordinance passed by the affirmative vote of at least three-fourths (3/4) of the Village Trustees, (Ill.Rev.Stat. 1987, Ch. 24, Par. 11-91-1, 11-91-2); and WHEREAS, a Plat of Vacation for the portion of the existing public street known as Turner Avenue to be vacated by the Village has been prepared by Gremley and Biedermann, Inc., Registered Land Surveyors, (Order No. 882497), and been approved by the Village Engineer. NOW, THEREFORE, BE IT ORDAINED by the Village President and Board of Trustees of the Village of Elk Grove Village as follows: Section 1: The terms of the Preamble are hereby incorporated into this Ordinance. Section 2: That Plat of Vacation for the portion of the existing public street known as Turner Avenue, as shown and prepared by Gremley and Biedermann, Inc., Registered Land Sur- veyors (Order No. 582497), is hereby approved, and the Village President is authorized to execute said Plat of Vacation for the following legally described property: That part of Turner Avenue in Section 32, Township 41 North, Range 11, East of the Third Principal Meridian, lying East of and adjoining the East line of Lot 13 in Ninth Addition to Elk Grove Village Sec- tion 12, being a resubdivision in Section 32 aforesaid, and lying Northerly and ad- joining the Northerly lines of Lots 14 and 15 in Tenth Addition to Elk Grove Village Section 12, being a resubdivision in Sec- tion 32 aforesaid; and lying Southerly of a curved line convex Southerly, having a radius of 905.0 feet and being drawn from the Northeast corner of Lot 13 aforesaid to the most Northerly corner of Lot 14 aforesaid, in Cook County, Illinois. Section 3: The Village Clerk is authorized to attest to the Village President's signature on said Plat of Vacation and to record it with the Cook County Recorder of Deeds. Section 4: This Ordinance shall be in full force and effect from and after its passage, by a vote of at least three-fourths (3/4) of the corporate authorities now holding office, and approval in the manner provided by law.
