HomeMy WebLinkAboutORDINANCE - 2044 - 5/23/1989 - SCAVENGERS/CODE AMENDEDORDINANCE NO. 2044 AN ORDINANCE AMENDING ARTICLE XL - SCAVENGERS - OF CHAPTER 18 OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE BY ADDING THERETO PROVISIONS FOR RESIDENTIAL RECYCLING BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That Article XL - Scavengers - of Chapter 18 of the Municipal Code be and the same is hereby amended by adding thereto a new section which shall read as follows: 18.4006 - Residential Recycling A. Single Family Detached Residences. The licensee for the single family detached residences within the Village shall provide for the recycling of materials as designated by the Village Board. Any contract between the licensed scavenger and the Village shall provide for the collection of the recyclable material, disposal of same in accordance with applicable laws and regulations and the distribution of the net proceeds collected from the sale of recyclable materials. B. Single Family Attached/Multi-Family Residences. All licensed scavengers of single family attached or multi -family residences in the Village shall submit to the Village an accept- able program or plan for the recycling of such materials designated as recyclables by the Village prior to receiving a scavenger license. Such program shall include, but is not limited to, the collection process, including use, location and quality of the recycling bin; the distribution of proceeds of the collected recyclables; and, if appli- cable, a cooperative agreement with the man- agement association of any affected multi- family development. The plan may provide for the licensed scavenger to process the recyclable material or in the alternative provide for a secondary scavenger, licensed with the Village, to administer the recycling program or plan. The Health Department, with approval by the Village Board, may authorize the issuance by the Finance Depart- ment of a temporary and conditional single family attached or multi -family scavenger license in the absence of a timely, accept- able recycling plan provided that said license shall automatically terminate if the licensee does not comply with the provisions of this section within a designated time period. Section 2: Any person, firm or corporation violating any of the provisions of this Ordinance shall be subject to a fine of not less than Twenty -Five ($25.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense; and a separate offense shall be deemed committed on each day during on or which a violation occurs or continues. Section 3: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 0 ABSENT: 1 APPROVED: Charles J.
